SJR39,1,2 Relating to: memorializing Congress to authorize a waiver to the required winter use of reformulated gasoline in Southeastern Wisconsin.

SJR39,1,5 Whereas, the reformulated gasoline program is a federal program created by section 211 (k) of the federal clean air act [42 USC 7545 (k)] and administered by the federal Environmental Protection Agency; and

SJR39,1,9 Whereas, since January 1, 1995, the federal clean air act has required that, within the region comprising Kenosha, Milwaukee, Ozaukee, Racine, Washington and Waukesha counties, only reformulated gasoline may be sold as fuel for gasoline-fueled vehicles; and

SJR39,1,12 Whereas, the federal clean air act mandated the use of reformulated gasoline in this region based upon the region being a nonattainment area for ozone air pollution; and

SJR39,1,15 Whereas, ozone air pollution is a problem during summer months and not during winter months due to the mechanism by which tropospheric ozone is formed; and

SJR39,2,4 Whereas, the mandated exclusive sale and use of reformulated gasoline within this region in winter months has caused numerous problems, including health-related effects, damages to and deleterious effects upon engines using reformulated gasoline, economic dislocation and injury as citizens shun sources of gasoline within the region and the undermining of public confidence in all state and federal air pollution control programs; now, therefore, be it

SJR39,2,9 Resolved by the senate, the Assembly concurring, That the members of the legislature of the state of Wisconsin urge President Clinton and the U. S. Congress to enact H.R. 2327 to authorize a waiver to the federal requirement that reformulated gasoline must be used in Kenosha, Milwaukee, Ozaukee, Racine, Washington and Waukesha counties during winter months; and, be it further

SJR39,2,13 Resolved, That the senate chief clerk shall provide a copy of this joint resolution to the President of the United States, to the president of the U.S. senate, to the speaker of the U.S. house of representatives and to each member of the U. S. congressional delegation from this state.
