SJR39,1,2 1Relating to: memorializing Congress to authorize a waiver to the required winter
2use of reformulated gasoline in Southeastern Wisconsin.
SJR39,1,53 Whereas, the reformulated gasoline program is a federal program created by
4section 211 (k) of the federal clean air act [42 USC 7545 (k)] and administered by the
5federal Environmental Protection Agency; and
SJR39,1,96 Whereas, since January 1, 1995, the federal clean air act has required that,
7within the region comprising Kenosha, Milwaukee, Ozaukee, Racine, Washington
8and Waukesha counties, only reformulated gasoline may be sold as fuel for
9gasoline-fueled vehicles; and
SJR39,1,1210 Whereas, the federal clean air act mandated the use of reformulated gasoline
11in this region based upon the region being a nonattainment area for ozone air
12pollution; and
SJR39,1,1513 Whereas, ozone air pollution is a problem during summer months and not
14during winter months due to the mechanism by which tropospheric ozone is formed;
15and
SJR39,2,416 Whereas, the mandated exclusive sale and use of reformulated gasoline within
17this region in winter months has caused numerous problems, including

1health-related effects, damages to and deleterious effects upon engines using
2reformulated gasoline, economic dislocation and injury as citizens shun sources of
3gasoline within the region and the undermining of public confidence in all state and
4federal air pollution control programs; now, therefore, be it
SJR39,2,9 5Resolved by the senate, the Assembly concurring, That the members of the
6legislature of the state of Wisconsin urge President Clinton and the U. S. Congress
7to enact H.R. 2327 to authorize a waiver to the federal requirement that
8reformulated gasoline must be used in Kenosha, Milwaukee, Ozaukee, Racine,
9Washington and Waukesha counties during winter months; and, be it further
SJR39,2,13 10Resolved, That the senate chief clerk shall provide a copy of this joint
11resolution to the President of the United States, to the president of the U.S. senate,
12to the speaker of the U.S. house of representatives and to each member of the U. S.
13congressional delegation from this state.
