AB156,1,2 1An Act to amend 59.25 (2) (a) of the statutes; relating to: a county treasurer's
2appointment of a deputy treasurer.

Under current law, a county treasurer may appoint in writing one or more
deputies to aid the treasurer in the discharge of his or her duties. Also under current
law, a register of deeds, clerk of courts and county clerk are required to appoint in
writing one or more deputies to aid the officeholder in the discharge of his or her
duties. Deputies appointed by the register of deeds and the clerk of courts serve at
the pleasure of the appointing authority. Generally, a deputy appointed by the
register of deeds, the clerk of courts and the county clerk is required to perform the
duties of his or her appointing authority if the appointing authority is disabled or if
the office is vacant. If the appointing authority is absent, a deputy appointed by the
register of deeds or the county clerk is required to perform the duties of the
appointing authority; a deputy appointed by the clerk of courts may perform the
duties of the clerk during the clerk's absence.
This bill changes current law by requiring a county treasurer to appoint one or
more deputies to aid the treasurer in the discharge of his or her duties. Under the
bill, a deputy serves at the treasurer's pleasure and the deputy is required to perform
all the duties of the treasurer if the treasurer is absent or, generally, if the treasurer
is disabled or if the office is vacant.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB156, s. 1 1Section 1. 59.25 (2) (a) of the statutes is amended to read:
AB156,2,132 59.25 (2) (a) The treasurer may appoint in writing shall appoint one or more
3deputies to aid the treasurer, under the treasurer's direction, in the discharge of the
4duties of the office of treasurer. A deputy appointed under this paragraph shall hold
5office at the treasurer's pleasure. The appointment shall be in writing and shall be
6filed and recorded in the treasurer's office.
Such deputy or deputies, in the absence
7of the treasurer from the treasurer's office or in case of a vacancy in said office or any
8disability of the treasurer to perform the duties of the office of treasurer, unless
9another is appointed therefor as provided in par. (b), may shall perform all of the
10duties of the office of treasurer until such vacancy is filled or such disability is
11removed. The person or persons so appointed shall take and file the official oath.
12They shall file their appointment with the clerk. The board may, at its annual
13meeting or at any special meeting, provide a salary for each such deputy.
