AB165,1,4 1An Act to amend 121.07 (6) (a) (intro.); and to create 121.91 (4) (f) of the
2statutes; relating to: increasing a school district's revenue limit by the amount
3necessary to comply with certain orders and excluding that amount from the
4school district's shared cost.
Analysis by the Legislative Reference Bureau
Current law limits the increase in the total amount of revenue that a school
district may receive from general school aids and property taxes. The maximum
allowable increase per pupil is $206. Several exceptions are provided. For example,
if a school district increases the services that it provides by adding responsibility for
providing a service transferred to it from another governmental unit, its revenue
limit is increased by the cost of that service.
This bill provides that a school district's revenue limit is increased by the
amount necessary to comply with an order of a court, a federal agency or a city,
village, town or county to remedy any violation of law relating to health or safety.
The bill also excludes from a school district's shared cost (costs that are aidable
through the general aid formula) the amount described above.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1Section 1. 121.07 (6) (a) (intro.) of the statutes is amended to read:
AB165,2,82 121.07 (6) (a) (intro.) "Shared cost" is the sum of the net cost of the general fund
3and the net cost of the debt service fund, except that "shared cost" excludes any costs,
4including attorney fees, incurred by a school district as a result of its participation
5in a lawsuit commenced against the state, beginning with such costs incurred in the
6fiscal year in which the lawsuit is commenced, and excludes the amount described
7under s. 121.91 (4) (f)
. In this paragraph, "net cost of the debt service fund" includes
8all of the following amounts:

AB165,2,1715 (1) This act first applies to the calculation of a school district's revenue limit
16for, and the payment of state aid in, the first school year beginning after the effective
17date of this subsection.
