AB437,1,3 1An Act to renumber and amend 350.05 (3); and to create 350.01 (10p), 350.01
2(11m) and 350.05 (3) (b) of the statutes; relating to: the operation of
3snowmobiles in races or derbies or on raceway facilities.
Analysis by the Legislative Reference Bureau
Under current law, a minor under the age of 12 may not operate a snowmobile
unless he or she is accompanied by an adult. A minor who is 13, 14 or 15 years old
may not operate a snowmobile unless the minor has completed the snowmobile
safety course established by the department of natural resources, is accompanied by
an adult or is accompanied by a minor who is over 14 years old and who has completed
the safety course. This bill exempts a minor from these operating restrictions if the
minor is operating a snowmobile in a snowmobile race or derby sponsored by a
county, town, city or village or by an organization such as a chamber of commerce or
snowmobile club or on a raceway if the minor is supervised by his or her parent or
guardian.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB437, s. 1 4Section 1. 350.01 (10p) of the statutes is created to read:

1350.01 (10p) "Raceway facility" means an area for a sanctioned snowmobile
2race or derby, including any training, warm-up or testing area, that has been
3designated for a sanctioned race or derby and that meets any applicable
4requirements under s. 350.04 (1) and (3) (b).
AB437, s. 2 5Section 2. 350.01 (11m) of the statutes is created to read:
AB437,2,86 350.01 (11m) "Sanctioned race or derby" means a competitive snowmobile
7event sponsored by a county, town, city or village, by a promoter, by a chamber of
8commerce or by a snowmobile club or other similar organization.
AB437, s. 3 9Section 3. 350.05 (3) of the statutes is renumbered 350.05 (3) (a) and amended
10to read:
AB437,2,1511 350.05 (3) (a) This section does not apply to the operation of snowmobiles by
12an operator under the age of 16 years who is operating a snowmobile upon lands
13owned or leased by the operator's parent or guardian. As used in this section, "leased
14lands" does not include lands leased by an organization of which said operator or the
15operator's parent or guardian is a member.
AB437, s. 4 16Section 4. 350.05 (3) (b) of the statutes is created to read:
AB437,2,1917 350.05 (3) (b) This section does not apply to a person under the age of 16 who
18is operating a snowmobile in a sanctioned race or derby or on a raceway facility if the
19person is supervised by his or her parent or guardian.
