AB482,1,4 1An Act to amend 125.085 (3) (a) 1.; and to create 125.07 (1) (b) 6. of the statutes;
2relating to: providing alcohol beverages to an underage person, offering false
3identification purporting to show that an underage person has attained the
4legal drinking age and providing a penalty.
Analysis by the Legislative Reference Bureau
Current law prohibits any person from providing alcohol beverages to anyone
who has not attained the legal drinking age of 21 years of age (underage person).
Current law does not specify whether the retail establishment or the individual who
dispensed the alcohol is liable for providing alcohol beverages to an underage person,
or whether both are liable. Under this bill, only one penalty may be imposed for each
alcohol beverage provided to an underage person contrary to law.
Current law also prohibits any person from making or altering an identification
card or providing false identification or other documents to an underage person
purporting to show that the underage person has attained the legal drinking age.
A person who violates these prohibitions without profiting from the violation may be
fined not less than $100 nor more than $500 or imprisoned for up to 30 days, or both.
The bill increases the fine to a minimum of $250 and to a maximum of $750.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

AB482,2,42 125.07 (1) (b) 6. Only one penalty may be imposed under this paragraph for
3each alcohol beverage provided to an underage person contrary to this section or a
4local ordinance in conformity with this section.
AB482, s. 2 5Section 2. 125.085 (3) (a) 1. of the statutes is amended to read:
AB482,2,146 125.085 (3) (a) 1. No person may make, alter or duplicate an official
7identification card, provide an official identification card to an underage person or
8knowingly provide other documentation to an underage person purporting to show
9that the underage person has attained the legal drinking age. No person may possess
10an official identification card or other documentation used for proof of age with the
11intent of providing it to an underage person. Except as provided in subds. 2. and 3.,
12any person who violates this subdivision may be fined not less than $100 $250 nor
13more than $500 $750 or imprisoned for not less than 10 days nor more than 30 days
14or both.
