AB643,1,2 1An Act to create 84.064 of the statutes; relating to: pipelines transporting mine
2discharge within the right-of-way of highways.

This bill prohibits the department of transportation from engineering a
pipeline for the transport of mine discharge within the right-of-way of any highway
unless the department of natural resources has considered and rejected a
closed-loop system for transporting the discharge from the mine. A closed-loop
system is a water treatment system, located at the mining site, for removing solids
from the water and recycling the water back to the mine with no resulting discharge
of water to surface or ground waters.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB643, s. 1 3Section 1. 84.064 of the statutes is created to read:
AB643,2,2 484.064 Pipelines transporting mine discharge. The department may not
5engineer any pipeline for the transport of mine discharge within the right-of-way
6of any highway unless the secretary of transportation receives a written statement
7from the secretary of natural resources that the department of natural resources has
8considered and rejected a water treatment system, located at the mining site, for

1removing solids from the water and recycling the water back to the mine with no
2resulting discharge of water to surface water or ground water.
