AB269,1,2 1An Act to repeal 30.71 (1); and to amend 30.71 (3) of the statutes; relating to:
2disposal facilities for toilet wastes from boats.

Under current law, establishments that are located on Lake Superior, Lake
Michigan, Green Bay, Sturgeon Bay, Sawyer's Harbor and certain parts of the Fox
River, and that provide berths or moorings to five or more boats that are equipped
with toilets, must provide onshore disposal facilities for toilet wastes from the boats.
Under this bill, these establishments must provide onshore disposal facilities if the
establishment is located on any body of water in the state.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB269, s. 1 3Section 1. 30.71 (1) of the statutes is repealed.
AB269, s. 2 4Section 2. 30.71 (3) of the statutes is amended to read:
AB269,2,55 30.71 (3) No person may operate for compensation or reward an establishment
6that has the capacity of providing berths or moorings to 5 or more boats that are
7equipped with toilets and that is located on an outlying water any of the waters of

1this state unless the establishment provides adequate fixed onshore disposal
2facilities for disposal of toilet wastes from the boats for which the establishment
3provides berths or moorings. If the establishment is unable to provide fixed onshore
4disposal facilities due to problems of accessibility to the boats, the establishment
5shall provide adequate portable disposal facilities for these toilet wastes.
