AB425,1,3 1An Act to amend 134.65 (3); and to create 134.65 (2) (c) of the statutes; relating
2to:
applications for retailer licenses for selling and giving away tobacco
3products.
Analysis by the Legislative Reference Bureau
Under current law, no person may sell or give away cigarettes or tobacco
products without holding a cigarettes and tobacco products, retailer license issued
by a city, village or town. Under this bill, cities, villages and towns must require
applicants for this license who will sell cigarettes or tobacco products from vending
machines to indicate on the application where the vending machines will be located.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB425, s. 1 4Section 1. 134.65 (2) (c) of the statutes is created to read:
AB425,2,25 134.65 (2) (c) A city, village or town shall require an applicant for a license
6under par. (a) or (b) who will sell cigarettes or tobacco products from a vending

1machine to specifically describe on the written application the premises where the
2vending machine will be located.
AB425, s. 2 3Section 2. 134.65 (3) of the statutes is amended to read:
AB425,2,74 134.65 (3) Each such license shall name the licensee and specifically describe
5the premises where such business is to be conducted or where any vending machine
6is to be located
. Such licenses shall not be transferable from one person to another
7nor from one premises to another.
