SB516,1,4 1An Act to amend 341.08 (2) (c), 341.11 (1) and 341.335 (title); and to create
2341.08 (2) (cm), 341.335 (1m) and 349.02 (2) (c) of the statutes; relating to:
3vehicle color and motor vehicle registration, making an appropriation and
4providing a penalty.
Analysis by the Legislative Reference Bureau
Under current law, an applicant for registration of a motor vehicle must provide
a description of the vehicle, including the vehicle's make, model and identification
number.
This bill requires the applicant for registration of a motor vehicle, other than
a motorcycle or a vehicle having a gross weight of more than 8,000 pounds, to include
the vehicle's color in the application. The bill requires DOT to include a place on the
registration application form for the applicant to identify the vehicle's current color,
if the color has changed since the vehicle was last registered. The bill specifies that
a registrant is not required to notify DOT that a vehicle's color has been changed, but
is required to state the correct color when renewing registration. Finally, the bill
prohibits law enforcement officers from stopping a vehicle solely because the vehicle
color differs from the color stated in its registration.
The bill provides one-time financing for fiscal year 2000-01 in the amount of
$37,500 from the segregated transportation fund for the purposes of implementing
this act.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB516, s. 1 1Section 1. 341.08 (2) (c) of the statutes is amended to read:
SB516,2,62 341.08 (2) (c) A description of the vehicle, including make, model, color,
3identification number and any other information which the department may
4reasonably require for proper identification of the vehicle. An application for a
5motorcycle or for a vehicle registered at a gross weight of more than 8,000 pounds is
6not required to include the vehicle color in the description of the vehicle.
SB516, s. 2 7Section 2. 341.08 (2) (cm) of the statutes is created to read:
SB516,2,108 341.08 (2) (cm) A place for the applicant to indicate whether the color of the
9vehicle being registered has changed from the color specified on the certificate of
10registration and, if so, the new color.
SB516, s. 3 11Section 3. 341.11 (1) of the statutes is amended to read:
SB516,2,2012 341.11 (1) Except as provided in sub. (2) the department upon registering a
13vehicle shall issue and deliver to the owner a certificate of registration. The
14certificate shall contain the name, residence and address of the owner ,; a brief
15description of the vehicle, including its color; the registration number assigned; and
16the date of expiration of registration. The certificate shall be in such form and may
17contain such additional information as the department deems advisable. A
18certificate for a motorcycle or for a vehicle registered at a gross weight of more than
198,000 pounds is not required to include the vehicle color in the description of the
20vehicle.
SB516, s. 4 21Section 4. 341.335 (title) of the statutes is amended to read:

1341.335 (title) Notice of change of address or, name or vehicle color.
SB516, s. 5 2Section 5. 341.335 (1m) of the statutes is created to read:
SB516,3,53 341.335 (1m) No person is required to notify the department before the next
4renewal of registration for the vehicle that a vehicle's color has been changed from
5the color stated in the most recent application for registration of the vehicle.
SB516, s. 6 6Section 6. 349.02 (2) (c) of the statutes is created to read:
SB516,3,137 349.02 (2) (c) Notwithstanding par. (a), a law enforcement officer may not stop
8a vehicle solely because the vehicle's color differs from the color stated in the
9application for registration of that vehicle. This paragraph does not limit the
10authority of a law enforcement officer to issue a citation for improper registration of
11a vehicle whose color differs from the color stated in the application for registration
12of the vehicle, if the difference is observed in the course of a stop or inspection made
13for other purposes.
SB516, s. 7 14Section 7. Nonstatutory provisions.
SB516,3,2015 (1) Notwithstanding section 16.42 (1) (e) of the statutes, in submitting
16information under section 16.42 of the statutes for the purpose of the 2001-03
17biennial budget bill, the department of transportation shall submit information
18concerning the appropriation under section 20.395 (5) (cq) of the statutes as though
19the amounts appropriated to the department under that appropriation for fiscal year
202000-01 were $37,500 less than the amounts in the schedule.
SB516, s. 8 21Section 8 . Appropriation changes.
SB516,3,2522 (1) In the schedule under section 20.005 (3) of the statutes for the appropriation
23to the department of transportation under section 20.395 (5) (cq) of the statutes, as
24affected by the acts of 1999, the dollar amount is increased by $37,500 for fiscal year
252000-01 for the purpose of reflecting vehicle color on motor vehicle registration.

1Section 9. Initial applicability.
SB516,4,32 (1) This act first applies to applications for registration of vehicles submitted
3to the department of transportation on the effective date of this subsection.
SB516, s. 10 4Section 10. Effective dates. This act takes effect on the first day of the 4th
5month beginning after publication or on July 1, 2000, whichever is later, except as
6follows:
SB516,4,77 (1) Section 8 of this act takes effect on the day after publication.
