AB507,1,2 1An Act to amend 101.10 (2) of the statutes; relating to: creating an exemption
2from the regulation of anhydrous ammonia.

Under current law, the department of commerce is required to promulgate rules
relating to the safe storage and handling of anhydrous ammonia. These rules
generally do not apply to refrigeration plants where ammonia is used solely as a
refrigerant, facilities where ammonia is manufactured, electric generating or
cogenerating facilities where ammonia is used as a refrigerant, and ammonia
transportation pipelines. This bill creates an additional exemption from these rules
for facilities where ammonia is used in pollution control devices.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB507, s. 1 3Section 1. 101.10 (2) of the statutes, as affected by 2001 Wisconsin Act 16, is
4amended to read:
AB507,2,95 101.10 (2) Rules. The department shall promulgate rules that prescribe
6reasonable standards relating to the safe storage and handling of anhydrous
7ammonia. The rules shall prescribe standards for the design, construction, repair,

1alteration, location, installation, inspection, and operation of anhydrous ammonia
2equipment. Except as otherwise provided in this subsection, the rules promulgated
3under this subsection do not apply to refrigeration plants where ammonia is used
4solely as a refrigerant, facilities where ammonia is used in pollution control devices
5or is
manufactured, electric generating or cogenerating facilities where ammonia is
6used as a refrigerant, and ammonia transportation pipelines. If ammonia is used on
7the premises of a facility or plant described under this subsection for a purpose or in
8a manner that is not related to the applicable exemption from the rules promulgated
9under this subsection, the exemption does not apply to that use.
