SB280,1,3 1An Act to create 121.91 (4) (i) of the statutes; relating to: increasing a school
2district's revenue limit by a portion of the school district's handicapped
3education costs.
Analysis by the Legislative Reference Bureau
Current law generally limits the increase in the total amount of revenue that
a school district may receive from general school aids and property taxes in a school
year to the amount of revenue increase allowed per pupil in the previous school year
increased by the percentage change in the consumer price index. Several exceptions
are provided. For example, if a school district increases the services that it provides
by adding responsibility for providing a service transferred to it from another
governmental unit, its revenue limit is increased by the cost of that service.
Currently, a school district is eligible to receive categorical state aid for its
handicapped education costs. If funding is insufficient to pay the full amount of aid,
payments are prorated.
This bill provides that, if payments are prorated, a school district's revenue
limit is increased by an amount equal to the difference between the amount that the
school district is eligible to receive and the amount that the school district actually
receives.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB280, s. 1 1Section 1. 121.91 (4) (i) of the statutes is created to read:
SB280,2,72 121.91 (4) (i) The limit otherwise applicable to a school district's revenue under
3sub. (2m) in any school year is increased by an amount equal to the difference
4between the amount of state aid that a school district is eligible to receive in the
5current school year under ss. 115.88 and 118.255 and the amount of state aid that
6the school district receives in the current school year under those sections, as
7determined by the state superintendent.

SB280,2,109 (1) This act first applies to the calculation of a school district's revenue limit
10for the school year beginning after the effective date of this subsection.
