SB287,1,3 1An Act to create 49.45 (6um) of the statutes; relating to: creating a grant
2program to supplement medical assistance payments to nursing homes in the
3city of Milwaukee and making an appropriation.

Under current law, as affected by 2001 Wisconsin Act 16, payment of state
general purpose revenues and federal medicaid moneys for services provided by a
nursing home to recipients of medical assistance (MA) is determined by the
department of health and family services (DHFS) under a formula that takes into
account allowable costs for direct care, support services, fuel and utilities, and
administration; net property tax or allowable municipal service costs; allowable
facility interest expense; and capital payment necessary for the provision of service
over time.
This bill creates a program to supplement MA payments, under which DHFS
may award grants to applying nursing homes that are located in the city of
Milwaukee; that have patient occupancy that is at least 80% of the nursing homes'
licensed bed capacities; that have more than 90% of residents that are eligible for
MA, including those with dual eligibility for MA and medicare; that are not affiliated
with a religious organization from which they receive operating support; that are
certified as providers of medicare; and that have at least 75% of employees that are
minority group members. For this grant program, the bill in each year of the 2001-03
fiscal biennium appropriates $1,558,000 in general purpose revenues, which would
be matched by federal medicaid moneys.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB287, s. 1 1Section 1. 49.45 (6um) of the statutes is created to read:
SB287,2,32 49.45 (6um) Supplemental grants to facilities in Milwaukee. (a) In this
3subsection:
SB287,2,44 1. "Medicare" has the meaning given in sub. (3) (L) 1. b.
SB287,2,55 2. "Minority group member" has the meaning given in s. 146.185 (1) (f).
SB287,2,76 3. "Nursing home" means a nursing home that is licensed under s. 50.03 and
7that is certified by the department as a provider of medical assistance.
SB287,2,118 (b) Notwithstanding sub. (6m), from the appropriations under s. 20.435 (4) (b)
9and (o), the department may award grants to supplement medical assistance
10payments in each fiscal year to an applying nursing home that meets all of the
11following criteria:
SB287,2,1212 1. The nursing home is located in the city of Milwaukee.
SB287,2,1413 2. Patient occupancy of the nursing home is at least 80% of the nursing home's
14licensed bed capacity.
SB287,2,1715 3. More than 90% of the nursing home's residents are eligible for medical
16assistance, including those who have dual eligibility for medical assistance and
17medicare.
SB287,2,1918 4. The nursing home is not affiliated with a religious organization from which
19the nursing home receives operating support.
SB287,2,2020 5. The nursing home is certified as a medicare provider.
SB287,2,2121 6. At least 75% of the nursing home's employees are minority group members.

1(c) Funding for grants under par. (b) shall be based on the total cost of the
2nursing home's services per patient who is a recipient of medical assistance or $140
3per patient day for a patient who is a recipient of medical assistance, whichever is
4less, less any payment received under sub. (6m).

SB287,3,126 (1) Supplemental grants to facilities in Milwaukee. In the schedule under
7section 20.005 (3) of the statutes for the appropriation to the department of health
8and family services under section 20.435 (4) (b) of the statutes, as affected by the acts
9of 2001, the dollar amount is increased by $1,558,000 for fiscal year 2001-02 and the
10dollar amount is increased by $1,558,000 for fiscal year 2002-03 to increase funding
11for supplemental medical assistance grants to nursing homes in the city of
12Milwaukee.
