SB380,1,4 An Act to repeal 29.193 (4) and 29.563 (3) (a) 9.; to renumber and amend 29.193 (3); to amend 29.053 (2) (a) (intro.) and 29.563 (3) (a) 7.; and to create 29.193 (3) (b) of the statutes; relating to: fishing licenses issued to disabled residents.

Analysis by the Legislative Reference Bureau

Under current law, the department of natural resources (DNR) issues annual fishing licenses to state residents who have certain disabilities for a fee of $6.25, including the issuing fee. Veterans who are state residents and who have certain disabilities pay a reduced fee. The period of validity for all of these licenses is a maximum of one year, so that these license holders must apply and qualify for these licenses on an annual basis. Under current law, the fee for a regular annual resident fishing license is $12, including the issuing fee, and the maximum period of validity is one year.

This bill changes the period of validity for a fishing license issued to a disabled resident or disabled resident veteran to be for as long as the licensee is a resident and his or her disability continues. Under the bill, these disabled residents are exempt from having to pay any fee for the license.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SB380, s. 1 Section 1. 29.053 (2) (a) (intro.) of the statutes is amended to read:

SB380,2,6 29.053 (2) (a) (intro.) The department may establish a fishing season on specified bodies of water in certain urban areas, as determined by rule by the department, that allows fishing only by persons who are under 16 years old or who are disabled and can produce the evidence specified in s. 29.193 (3) (a), (b) or (c) 1., 2., or 3., subject to all of the following conditions:

SB380, s. 2 Section 2. 29.193 (3) of the statutes is renumbered 29.193 (3) (a), and 29.193 (3) (a) (intro.), as renumbered, is amended to read:

SB380,2,12 29.193 (3) Fishing license for disabled persons. (a) (intro.) The department shall issue, subject to s. 29.024 (2g), an annual a disabled person fishing license without charge to any resident who applies for this license and who does one of the following:

SB380, s. 3 Section 3. 29.193 (3) (b) of the statutes is created to read:

SB380,2,16 29.193 (3) (b) A fishing license issued to a disabled person under par. (a) is valid from the date of issuance and remains valid as long as the person continues to be a resident and continues to meet the requirement of par. (a) 1., 2., or 3.

SB380, s. 4 Section 4. 29.193 (4) of the statutes is repealed.

SB380, s. 5 Section 5. 29.563 (3) (a) 7. of the statutes is amended to read:

SB380,2,20 29.563 (3) (a) 7. Annual fishing Fishing issued to a disabled person under s. 29.193 (3) (a) or (b) 1., 2., or 3.: $6.25 $0.

SB380, s. 6 Section 6. 29.563 (3) (a) 9. of the statutes is repealed.

SB380, s. 7 Section 7. Initial applicability.

SB380,3,3 (1) This act first applies to fishing licenses issued to disabled residents on the effective date of this subsection.

SB380,3,6 (1) This act takes effect on May 1, 2002, or the day after publication, whichever is later.
