SB444,1,2 An Act to amend 13.489 (2) of the statutes; relating to: requiring life cycle cost statements for major highway projects recommended for enumeration.

Analysis by the Legislative Reference Bureau

Under current law, the department of transportation (DOT) administers a major highway projects program. A major highway project is a project having a total cost of more than $5,000,000 and involving construction of a new highway 2.5 miles or more in length; reconstruction or reconditioning of an existing highway that relocates at least 2.5 miles of the highway or adds one or more lanes at least five miles in length to the highway; or improvement of an existing multilane divided highway to freeway standards. In preparation for each biennial budget bill, DOT is required to submit a report of its recommendations for adjustments in the major highway projects program by September 15 of each even-numbered year to the transportation projects commission (TPC).

This bill provides that, if any report to TPC recommends enumeration of a major highway project, DOT is required to submit a life cycle cost statement for the project to the governor, TPC, the building commission, and the joint committee on finance. The cost statement must include the estimated costs associated with the project for its life cycle (from initial construction to first reconstruction), including all maintenance, signage, and policing costs.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SB444, s. 1 Section 1. 13.489 (2) of the statutes is amended to read:

SB444,2,14 13.489 (2) Department to report proposed projects. Subject to s. 85.05, the department of transportation shall report to the commission not later than September 15 of each even-numbered year and at such other times as required under s. 84.013 (6) concerning its recommendations for adjustments in the major highway projects program under s. 84.013. If the report under this subsection includes a recommendation to enumerate one or more major highway projects under s. 84.013 (3), the department of transportation shall provide a life cycle cost statement for each proposed project to the governor, the transportation projects commission, the building commission, and the joint committee on finance. The life cycle cost statement shall include an estimate of the costs of constructing, maintaining, resurfacing, minor and major reconditioning, policing, plowing, painting, signing, and reconstructing the major highway project until the first reconstruction of the project is completed.
