AB670,1,2 1An Act to amend 153.60 (1) of the statutes; relating to: exempting medical
2residents and fellows from health care information data annual assessments.

Under current law, as affected by 2003 Wisconsin Act 33 (the biennial budget
act), the Department of Health and Facility Services (DHFS) collects health care
information from health care providers, and analyzes and disseminates the
information to interested parties, except that, by September 2003, the Department
of Administration must contract with an entity to collect the health care information
from hospitals and ambulatory surgery centers, beginning within 18 months after
the date of the contract.
Also under current law, as affected by the biennial budget act, DHFS must
annually assess health care providers (except, beginning July 1, 2004, hospitals and
ambulatory surgery centers) for, among other things, the DHFS costs for health care
data collection, database development and maintenance, and generation of data files
and standard reports. DHFS must estimate these costs and determine the amounts
of the assessments by subtracting, from the cost estimate, the estimated revenue
DHFS will obtain from charging user fees for health care data reports generated by
DHFS. A health care provider that is not a facility may not be assessed more than
$75 each fiscal year.
This bill exempts medical residents and fellows from the health care
information assessments annually imposed on health care providers by DHFS,
beginning with assessments imposed for fiscal year 2004-05.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB670, s. 1 1Section 1. 153.60 (1) of the statutes, as affected by 2003 Wisconsin Act 33, is
2amended to read:
AB670,3,53 153.60 (1) The department shall, by the first October 1 after the
4commencement of each fiscal year, estimate the total amount of expenditures under
5this chapter for the department and the board for that fiscal year for data collection,
6database development and maintenance, generation of data files and standard
7reports, orientation and training provided under s. 153.05 (9) (a) and maintaining
8the board. The department shall assess the estimated total amount for that fiscal
9year less the estimated total amount to be received for purposes of administration
10of this chapter under s. 20.435 (4) (hi) during the fiscal year, the unencumbered
11balance of the amount received for purposes of administration of this chapter under
12s. 20.435 (4) (hi) from the prior fiscal year and the amount in the appropriation
13account under s. 20.435 (1) (dg), 1997 stats., for the fiscal year, to health care
14providers, other than hospitals and ambulatory surgery centers, who are in a class
15of health care providers from whom the department collects data under this chapter
16in a manner specified by the department by rule. The department may not assess
17hospitals, ambulatory surgery centers, and medical residents or fellows in medical
18education who are participating in accredited training programs under the
19supervision of the medical staff of hospitals.
The department shall obtain approval
20from the board for the amounts of assessments for health care providers other than
21hospitals and ambulatory surgery centers. The department shall work together with

1the department of regulation and licensing to develop a mechanism for collecting
2assessments from health care providers other than hospitals and ambulatory
3surgery centers. No health care provider that is not a facility may be assessed under
4this subsection an amount that exceeds $75 per fiscal year. All payments of
5assessments shall be credited to the appropriation under s. 20.435 (4) (hg).

AB670,3,87 (1) This act first applies to assessments under section 153.60 (1) of the statutes
8for fiscal year 2004-05.
