SB166,1,5 1An Act to renumber and amend 40.22 (2) (g); to amend 40.22 (2) (b) and 40.22
2(4); and to create 20.285 (1) (ag) and 40.22 (2) (g) 2. of the statutes; relating
3to:
participation in the Wisconsin Retirement System for teaching assistants
4and project assistants employed by the University of Wisconsin System and
5making an appropriation.
Analysis by the Legislative Reference Bureau
Under current law, with some exceptions, any state employee or an employee
of a participating employer in the Wisconsin Retirement System (WRS) is eligible to
participate in the WRS if the employee is expected to work at least one-third of what
is considered full-time employment and the employee's expected duration of
employment is at least one year. Currently, however, teaching assistants, project
assistants, and students who are employees in training at the University of
Wisconsin System and the University of Wisconsin Hospitals and Clinics Authority
and students appointed by a school or other education system in which the person
is regularly enrolled as a student and is attending classes to perform services
incidental to the person's course of study at that school or education system are
prohibited from participating in the WRS. This bill eliminates this prohibition with
respect to teaching assistants and project assistants at the University of Wisconsin
System.
This bill will be referred to the Joint Survey Committee on Retirement Systems
for a detailed analysis, which will be printed as an appendix to this bill.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB166, s. 1 1Section 1. 20.005 (3) (schedule) of the statutes: at the appropriate place, insert
2the following amounts for the purposes indicated: - See PDF for table PDF
SB166, s. 2 3Section 2. 20.285 (1) (ag) of the statutes is created to read:
SB166,2,84 20.285 (1) (ag) Retirement contributions for teaching assistants and project
5assistants.
The amounts in the schedule for the payment of contributions under s.
640.05 (1), (2), and (2m) for teaching assistants, as defined in s. 111.81 (19m), and
7project assistants, as defined in s. 111.81 (15m), who are participating employees in
8the Wisconsin Retirement System.
SB166, s. 3 9Section 3. 40.22 (2) (b) of the statutes is amended to read:

11year and the employee is not a teaching assistant, as defined in s. 111.81 (19m), or
12a project assistant, as defined in s. 111.81 (15m)

1Section 4. 40.22 (2) (g) of the statutes is renumbered 40.22 (2) (g) 1. and
2amended to read:

4by the university under s. 36.19, or by the University of Wisconsin Hospitals and
5Clinics Authority, as a student assistant or employee in training or is appointed by

SB166, s. 5 9Section 5. 40.22 (2) (g) 2. of the statutes is created to read:

11assistant, as defined in s. 111.81 (19m), or a project assistant, as defined in s. 111.81
12(15m).
SB166, s. 6 13Section 6. 40.22 (4) of the statutes is amended to read:
SB166,3,1814 40.22 (4) For purposes of s. 40.02 (25), a person who is employed by a state
15agency shall be deemed to have become a state employee on the date the person
16becomes a participating state employee. No participating employee , other than a
17participating employee who is a teaching assistant, as defined in s. 111.81 (19m), or
18a project assistant, as defined in s. 111.81 (15m),
may be included under s. 40.52 (3).
SB166, s. 7 19Section 7. Effective date.
SB166,3,2020 (1) This act takes effect on the January 1 after publication.
