SB250,1,5 An Act to amend 20.866 (1) (u); to create 13.48 (36), 20.866 (2) (zbs) and 20.867 (3) (bn) of the statutes; and to affect 2003 Wisconsin Act .... (senate Bill 44), section 9106 (1) (am) and 2003 Wisconsin Act .... (senate Bill 44), section 9106 (8); relating to: construction and operation of a Hmong cultural center, granting bonding authority, and making appropriations.

Analysis by the Legislative Reference Bureau

This bill provides for the state to construct a Hmong cultural center in the city of Milwaukee at a cost of $3,000,000. Under the bill, the center is to be operated by an organization determined by the secretary of administration that represents the nonsectarian cultural interests of the Hmong people. Under the bill, the specific site for the center is determined by the building commission.

The bill authorizes the issuance of $3,000,000 of general obligation bonds, to be repaid with general purpose revenue, to finance construction of the center. The bill does not appropriate any moneys to operate the center.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SB250, s. 1 Section 1. 13.48 (36) of the statutes is created to read:

SB250,2,12 13.48 (36) Hmong cultural center. (a) The legislature finds and determines that a significant number of Hmong people are citizens of this state, that the Hmong people have a proud heritage that needs to be recognized and preserved, and that the Hmong people have experienced difficulties assimilating in this state. The legislature finds that supporting the Hmong people in their efforts to recognize their heritage and to gain the full advantages of citizenship in this state is a statewide responsibility of statewide dimension. To better ensure that the heritage of the Hmong people is preserved and to better enable the Hmong people to gain the full advantages of citizenship in this state, the legislature finds that it will have a direct and immediate effect on a matter of statewide concern for the state to construct and provide for the operation of a Hmong cultural center.

SB250,2,19 (b) Notwithstanding s. 18.04 (1) and (2), the building commission shall authorize $3,000,000 in general fund supported borrowing to make a grant to an organization designated by the secretary of administration that represents the cultural interests of Hmong people for construction of a Hmong cultural center in the city of Milwaukee. As a condition precedent to receipt of the grant, the organization shall enter into an agreement with the secretary guaranteeing that the center will be operated to serve the nonsectarian cultural interests of the Hmong people.

SB250,2,24 (c) If, for any reason, the facility that is constructed with funds from the grant under par. (b) is not used to construct a Hmong cultural center in the city of Milwaukee, or the center is not operated to serve the nonsectarian cultural interests of the Hmong people, the state shall retain an ownership interest in the facility equal to the amount of the state's grant.

SB250, s. 2 Section 2. 20.866 (1) (u) of the statutes, as affected by 2003 Wisconsin Act .... (Senate Bill 44), is amended to read:

(2) (zp) and ss. 20.115 (2) (d) and (7) (b) and (f), 20.190 (1) (c), (d), (i), and (j), 20.225 (1) (c) and (i), 20.245 (1) (e) and (j), 20.250 (1) (c) and (e), 20.255 (1) (d), 20.285 (1) (d), (db), (fh), (ih), (je), (jq), (kd), (km), and (ko) and (5) (i), 20.320 (1) (c) and (t) and (2) (c), 20.370 (7) (aa), (ac), (ag), (aq), (ar), (at), (au), (bq), (ca), (cb), (cc), (cd), (ce), (cf), (ea), (eq), and (er), 20.395 (6) (af), (aq), (ar), and (at), 20.410 (1) (e), (ec), and (ko) and (3) (e), 20.435 (2) (ee) and (6) (e), 20.465 (1) (d), 20.485 (1) (f) and (go), (3) (t) and (4) (qm), 20.505 (4), (es), (et), (ha), and (hb) and (5) (c), (g) and (kc), 20.855 (8) (a) and 20.867 (1) (a) and (b) and (3) (a), (b), (bm), (bn), (bp), (br), (bt), (g), (h), (i), and (q) for the payment of principal and interest on public debt contracted under subchs. I and IV of ch. 18.

SB250, s. 3 Section 3. 20.866 (2) (zbs) of the statutes is created to read:

SB250,3,19 20.866 (2) (zbs) Hmong cultural center. From the capital improvement fund, a sum sufficient for the building commission to provide a grant to an organization specified in s. 13.48 (36) (b) for construction of a Hmong cultural center in the city of Milwaukee. The state may contract public debt in an amount not to exceed $3,000,000 for this purpose.

SB250, s. 4 Section 4. 20.867 (3) (bn) of the statutes is created to read:

SB250,4,2 20.867 (3) (bn) Principal repayment, interest and rebates; Hmong cultural center. A sum sufficient to reimburse s. 20.866 (1) (u) for the payment of principal and interest costs incurred in financing the construction of a Hmong cultural center in the city of Milwaukee, and to make the payments determined by the building commission under s. 13.488 (1) (m) that are attributable to the proceeds of obligations incurred in financing the construction of the center.

SB250, s. 6 Section 6. 2003 Wisconsin Act .... (Senate Bill 44), section 9106 (8) is created to read:

SB250,4,31 [2003 Wisconsin Act .... (Senate Bill 44)] Section 9106 (8) Adjustment of totals. In the 2003-05 Authorized State Building Program, the appropriate totals are adjusted to reflect the changes made by Section 5 of this act.

SB250, s. 7 Section 7. Nonstatutory provisions.

SB250,5,2 (1) Notwithstanding section 13.48 (36) (b) of the statutes, as created by this act, the building commission shall not make a grant to an organization for construction of the Hmong cultural center project, as enumerated in subsection (1) (hm), under section 13.48 (36) of the statutes, as created by this act, unless the department of administration has reviewed and approved plans for the project. Notwithstanding sections 16.85 (1) and 16.855 (1) of the statutes, the department of administration shall not supervise any services or work or let any contract for the project. Section 16.87 of the statutes does not apply to the project.
