SB429,1,2 1An Act to create 280.27 of the statutes; relating to: requiring air filtration for
2certain wells.

This bill requires the owner of a residential well that is drilled, rather than
driven, to filter air that enters the well to prevent bacteria from contaminating the
well water if water from the well tests positive for bacteria or if construction of the
well begins more than six months after the bill is enacted.
The bill also requires the secretary of natural resources to appoint a committee
to review the operation of the filtering requirement established by the bill and
requires the committee to report the results of its review to the legislature in five
years.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB429, s. 1 3Section 1. 280.27 of the statutes is created to read:
SB429,2,2 4280.27 Air filtration for residential wells. (1) The owner of a residential
5well, other than a driven well, that has a casing shall filter air that enters the well

1to prevent airborne bacteria from contaminating the well water if any of the following
2applies:
SB429,2,43 (a) The construction of the well begins after the effective date of this paragraph

SB429,2,7 6(2) (a) The secretary of natural resources shall appoint a committee under s.
715.04 (1) (c) consisting of the following members:
SB429,2,88 1. A representative of the department.
SB429,2,99 2. A representative of the state laboratory of hygiene.
SB429,2,1010 3. A representative of the Wisconsin Public Health Association.
SB429,2,1111 4. A representative of the Wisconsin Well Water Association, Inc.
SB429,2,1212 5. A representative of the Wisconsin Rural Water Association.
SB429,2,1713 (b) The committee appointed under par. (a) shall review the operation of the
14requirement under sub. (1) and shall report the results of its review, including any
15recommendations for changes to sub. (1), to the legislature under s. 13.172 (2) no
16later than the first day of the 60th month beginning after the effective date of this

SB429,2,1918 (c) The committee appointed under par. (a) terminates on the day on which it
19submits the report under par. (b).
SB429, s. 2 20Section 2. Effective date.
SB429,2,2221 (1) This act takes effect on the first day of the 7th month beginning after
