AB1019,1,2 1An Act to create 85.165 of the statutes; relating to: background checks for
2certain Department of Transportation employees.

This bill requires the Department of Transportation to perform a background
criminal check, using fingerprint analyses by the Federal Bureau of Investigation,
on any person who is hired to fill a position in the Division of Motor Vehicles (DMV).
The bill does not require the background check on current DMV employees or any
potential DMV employee who has been previously employed by the state.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB1019, s. 1 3Section 1. 85.165 of the statutes is created to read:
AB1019,2,7 485.165 Background investigations. The department of transportation,
5with the assistance of the department of justice, shall conduct a background
6investigation of any person who has not been previously employed by the state and
7who has been selected to fill a position within the division of motor vehicles. The

1department of transportation shall require the person to be fingerprinted on 2
2fingerprint cards each bearing a complete set of the person's fingerprints, or by other
3technologies approved by law enforcement agencies. The department of justice shall
4submit the fingerprint cards to the federal bureau of investigation for the purposes
5of verifying the identity of the person fingerprinted and obtaining records of his or
6her criminal arrests and convictions. The department of transportation shall
7reimburse the department of justice for its services under this section.

AB1019,2,109 (1) This act first applies to persons who are selected to fill a position on the
10effective date of this subsection.
