SB206,1,2 1An Act to amend 121.54 (10) of the statutes; relating to: transportation for
2pupils participating in the open enrollment program.
Analysis by the Legislative Reference Bureau
Current law authorizes a school board to provide transportation under the open
enrollment program for nonresident pupils who are attending public school in the
school district or for resident pupils who are attending school in another school
district. The school board may not provide transportation, however, for a
nonresident pupil to or from a location within the boundaries of the school district
in which the pupil resides. This bill allows a school board to do so with the approval
of the school board of the school district in which the pupil resides.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB206, s. 1 3Section 1. 121.54 (10) of the statutes is amended to read:
SB206,2,64 121.54 (10) Attendance in nonresident school district. Subject to s. 118.51
5(14) (a) 2., a school board may elect to provide transportation, including
6transportation to and from summer classes, for nonresident pupils who are

1attending public school in the school district under s. 118.51 or 121.84 (4), or its
2resident pupils who are attending public school in another school district under s.
3118.51 or 121.84 (4), or both, except that a school board may not provide
4transportation under this subsection for a nonresident pupil to or from a location
5within the boundaries of the school district in which the pupil resides unless the
6school board of that school district approves

SB206, s. 2 7Section 2. Initial applicability.
SB206,2,98 (1) This act first applies to state aid distributed in the school year beginning
9after the effective date of this subsection.
