SB334,1,3 1An Act to amend 343.50 (4); and to create 343.01 (2) (ba), 343.06 (1) (L), 343.14
2(2) (er), 343.17 (3) (a) 14. and 343.50 (10m) of the statutes; relating to: driver
3licenses and identification cards for aliens.
Analysis by the Legislative Reference Bureau
Under current law, a person who wishes to receive a driver's license or an
identification card from the Department of Transportation (DOT) must provide
certain information to DOT, including the person's name, address, date of birth, and
physically descriptive information. A license or an identification card that is issued
by DOT includes a picture of the person, identifying information, the person's
signature, and physically descriptive information.
Under this bill, an applicant for a driver's license or identification card who is
an alien resident of this state must present documentary proof that the person is
legally residing within the state and the date on which his or her status as a legal
alien expires. The bill requires DOT to include on the person's driver's license or
identification card the date on which the person's status as a legal alien expires.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1Section 1. 343.01 (2) (ba) of the statutes is created to read:
SB334,2,32 343.01 (2) (ba) "Alien" means a person who is legally present in this state under
38 USC 1101 to 1105 or other applicable federal law.
SB334, s. 2 4Section 2. 343.06 (1) (L) of the statutes is created to read:
SB334,2,65 343.06 (1) (L) To any person who is not legally present in this state under 8 USC
61101
to 1105 or other applicable federal law.
SB334, s. 3 7Section 3. 343.14 (2) (er) of the statutes is created to read:
SB334,2,108 343.14 (2) (er) If the application is made by a person who is an alien,
9documentary proof that the applicant is legally residing within this state and the
10date on which the applicant's status as an alien expires.
SB334, s. 4 11Section 4. 343.17 (3) (a) 14. of the statutes is created to read:

SB334, s. 5 14Section 5. 343.50 (4) of the statutes is amended to read:
SB334,2,2215 343.50 (4) Application. The application for an identification card shall include
16any information required under ss. 85.103 (2) and 343.14 (2) (a), (b), (bm), (br), and
17(em), and (er), and such further information as the department may reasonably
18require to enable it to determine whether the applicant is entitled by law to an
19identification card. The department shall, as part of the application process, take a
20photograph of the applicant to comply with sub. (3). No application may be processed
21without the photograph being taken. Misrepresentations in violation of s. 343.14 (5)
22are punishable as provided in s. 343.14 (9).

1343.50 (10m) Persons who may not receive a card. The department may not
2issue an identification card to any person who is not legally present in this state
3under 8 USC 1101 to 1105 or other applicable federal law.
