SB366,1,2 1An Act to create 86.19 (7) of the statutes; relating to: the erection of signs
2prohibiting the use of engine brakes on freeways and expressways.
Analysis by the Legislative Reference Bureau
Under current law, the Department of Transportation (DOT) erects signs for
the guidance or warning of traffic along highways, including freeways and
expressways. This bill directs DOT to place signs along freeways and expressways
prohibiting the use, except in an emergency, of engine brakes if a municipality
prohibits the use of engine brakes within the municipality.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB366, s. 1 3Section 1. 86.19 (7) of the statutes is created to read:
SB366,2,54 86.19 (7) In this subsection, "engine brake" means a hydraulically operated
5device that converts a power-producing diesel engine into a power-absorbing,
6retarding mechanism that is used to augment or replace the use of the primary brake
7system or mechanism on a motor vehicle. If the governing body of a municipality

1passes a resolution prohibiting the use of engine brakes, except in an emergency, on
2a freeway or expressway within the municipality, the department shall, at the
3request of the municipality, erect and maintain signs along the freeway or
4expressway stating that the use of engine brakes are prohibited except in an
5emergency.
