SB503,1,2 1An Act to amend 753.075 (3) (a) of the statutes; relating to: the compensation
2paid for temporary reserve judges.

Currently, temporary reserve judges are paid a per diem that is equal to
$302.02, based on a statutorily established figure that has been increased by the
percentage increase that circuit court judges have received.
This bill creates a per diem rate for temporary reserve judges equal to 90
percent of the daily rate paid to the judge of the court to which the reserve judge is
assigned. If the temporary reserve judge is acting as a circuit court judge, based on
the daily salary of circuit court judges, the per diem rate would be approximately
$389.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB503, s. 1 3Section 1. 753.075 (3) (a) of the statutes is amended to read:
SB503,2,144 753.075 (3) (a) Temporary reserve judges shall receive a per diem of $255.66.
5Commencing August 1, 1998, the per diem for temporary reserve judges shall be

1increased by the same percentage increase authorized for circuit court judges'
2salaries
equal to 90 percent of the daily salary of a judge of the court to which the
3reserve judge is assigned
. While serving outside the county in which they reside
4temporary reserve judges shall also receive actual and necessary expenses incurred
5in the discharge of judicial duties. This per diem compensation is not subject to s.
640.26 but the combined amount of this compensation and any other judicial
7compensation together with retirement annuities under the Wisconsin retirement
8system, the Milwaukee County retirement fund and other state, county, municipal,
9or other Wisconsin governmental retirement funds received by him or her during any
10one calendar year shall not exceed the yearly compensation of a circuit judge. The
11per diem compensation and actual and necessary expenses shall be paid from the
12appropriation under s. 20.625 (1) (a) when the judge is assigned to a circuit court and
13from the appropriation under s. 20.660 (1) (a) when the judge is assigned to the court
14of appeals.
