AB494,1,3 1An Act to create 38.08 (1) (a) 3. of the statutes; relating to: the membership
2of a technical college district board that governs a technical college district
3encompassing a 1st class city.
Analysis by the Legislative Reference Bureau
Under current law, a technical college district board (district board) consists of
nine members who are residents of the technical college district, including two
employers, two employees, a school district administrator, a state or local elected
official, and three additional members. This bill requires at least one member of a
district board that governs a technical college district encompassing a 1st class city
(presently only Milwaukee) to be a resident of a county other than Milwaukee
County. The bill permits current members of that district board to serve their terms,
but requires all vacancies occurring on that district board to be filled with members
who are residents of counties other than Milwaukee County until the membership
of the district board is brought into conformance with this bill.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB494, s. 1 4Section 1. 38.08 (1) (a) 3. of the statutes is created to read:

138.08 (1) (a) 3. At least one member of a district board that governs a district
2encompassing a 1st class city shall be a resident of a county other than the county
3in which the 1st class city is primarily located.
AB494, s. 2 4Section 2. Nonstatutory provisions.
AB494,2,65 (1) Technical college district board membership in district encompassing 1st
6class city.
AB494,2,117 (a) Notwithstanding section 38.08 (1) (a) 3. of the statutes, as created by this
8act, the members of a technical college district board that governs a technical college
9district encompassing a 1st class city who are serving on the effective date of this
10paragraph may continue to serve for the terms for which they were appointed or until
11their successors are appointed and qualified, whichever occurs later.
AB494,2,1912 (b) In order to bring the membership of a technical college district board that
13governs a technical college district encompassing a 1st class city into conformance
14with section 38.08 (1) (a) 3. of the statutes, as created by this act, all vacancies
15occurring on that district board on or after the effective date of this paragraph shall
16be filled with members who meet the qualifications specified in section 38.08 (1) (a)
173. of the statutes, as created by this act, until the membership of that district board
18is brought into conformance with section 38.08 (1) (a) 3. of the statutes, as created
19by this act.
