AB237,1,3 1An Act to create 101.023 of the statutes; relating to: prohibiting the
2Department of Commerce from promulgating rules requiring registration of
3certain persons engaged in the construction business.
Analysis by the Legislative Reference Bureau
The Department of Commerce (Commerce) administers various laws, including
building codes, that promote safety in public and private buildings and in the
subsystems of those buildings. To that end, Commerce issues various registrations,
licenses, permits, and other credentials (registrations) to persons engaged in the
construction trades, such as electricians and plumbers.
This bill prohibits Commerce from promulgating any rule requiring a person
who is engaged in the construction business to hold a registration, unless the rule
relates to a registration specifically authorized or required by statute to be issued by
Commerce.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB237, s. 1 4Section 1. 101.023 of the statutes is created to read:

1101.023 Rules requiring certain credentials prohibited. (1) In this
2section:
AB237,2,43 (a) "Construction business" means the business of building, altering, or
4repairing public buildings, places of employment, or dwellings.
AB237,2,65 (b) "Registration" means a registration, license, permit, certification, or other
6credential.
AB237,2,9 7(2) The department may not promulgate any rule that requires a person who
8is engaged, or who offers to engage, in a construction business to hold a registration
9issued by the department.
AB237,2,12 10(3) Subsection (2) does not prohibit the department from promulgating a rule
11relating to any registration that the department is specifically required or
12authorized to issue under this chapter or ch. 145.
