SB438,1,3 1An Act to amend 346.95 (8); and to create 340.01 (28t) and 346.94 (21) of the
2statutes; relating to: the operation of minitrucks on highways and providing
3a penalty.
Analysis by the Legislative Reference Bureau
This bill specifies that minitrucks may be operated on all highways in this state
except for interstate highways and highways having a speed limit of more than 55
miles per hour. The bill defines a minitruck as a motor truck having a top speed of
not more than 60 miles per hour that is: 1) powered by an internal combustion engine
with a piston or rotor displacement of not less than 660 cubic centimeters; 2) not more
than 60 inches in width; 3) not more than 1,600 pounds in dry, unloaded weight; and
4) manufactured with a locking enclosed cab and a heated interior. A minitruck must
be registered as are other motor trucks and is subject to all requirements applicable
to other, similar vehicles. If a person operates a minitruck on an interstate highway
or a highway having a speed limit of more than 55 miles per hour, the person may
be required to forfeit not less than $30 nor more than $300.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1Section 1. 340.01 (28t) of the statutes is created to read:
SB438,2,32 340.01 (28t) "Minitruck" means a motor truck having a top speed of not more
3than 60 miles per hour that is all of the following:
SB438,2,54 (a) Powered by an internal combustion engine with a piston or rotor
5displacement of not less than 660 cubic centimeters.
SB438,2,66 (b) Not more than 60 inches in width.
SB438,2,77 (c) Not more than 1,600 pounds in dry, unloaded weight.
SB438,2,88 (d) Manufactured with a locking enclosed cab and a heated interior.
SB438, s. 2 9Section 2. 346.94 (21) of the statutes is created to read:
SB438,2,1110 346.94 (21) Operation of minitrucks on highways. (a) Except as provided in
11par. (b), a person may operate a minitruck on any highway.
SB438,2,1212 (b) No person may operate a minitruck on any of the following highways:
SB438,2,1313 1. Any highway having a speed limit of more than 55 miles per hour.
SB438,2,1414 2. Any interstate highway designated under s. 84.29 (2).
SB438, s. 3 15Section 3. 346.95 (8) of the statutes is amended to read:
