1(4) (d) exceed actual fiscal year institutional costs by more than 2% or more, all
2moneys in excess of that 2% shall be remitted to the counties during the subsequent
3calendar year or transferred to the appropriation account under par. (kx) during the
4subsequent fiscal year. Each county and the department shall receive a
5proportionate share of the remittance and transfer depending on the total number
6of days of placement at juvenile correctional institutions including the Mendota
7Juvenile Treatment Center. Counties shall use the funds for purposes specified in
8s. 301.26. The department shall deposit in the general fund the amounts transferred
9under this paragraph to the appropriation account under par. (kx).
AB40, s. 632 10Section 632 . 20.410 (3) (ho) of the statutes is amended to read:
AB40,405,411 20.410 (3) (ho) Juvenile residential aftercare. The amounts in the schedule for
12providing foster care, group home care, and institutional child care to delinquent
13juveniles under ss. 49.19 (10) (d), 49.45 (25) (bj), 301.26 (4) (c), 938.48 (4) and (14),
14and 938.52. All moneys transferred under s. 301.26 (4) (cm) and all moneys received

20shall be transferred to the appropriation account under par. (hm) as provided in s.
21301.26 (4) (ct), except that, if those moneys generated exceed those costs
by more than
222% or more, all moneys in excess of 2% shall be remitted to the counties during the
23subsequent calendar year or transferred to the appropriation account under par. (kx)
24during the subsequent fiscal year. Each county and the department shall receive a
25proportionate share of the remittance and transfer depending on the total number

1under s. 46.284 (5), for Medical Assistance payment adjustments under s. 49.45 (52),
2and
(a) for services described in s. 49.45 (52) (a) 1., for Medical Assistance payments
3under s. 49.45 (6tw), and for Medical Assistance payments under s. 49.45 (53) for
4services described in s. 49.45 (53) that are provided before January 1, 2012
. Social
5services disbursements under s. 46.03 (20) (b) may be made from this appropriation.
6Refunds received relating to payments made under s. 46.03 (20) (b) for the provision
7of services for which moneys are appropriated under this paragraph shall be
8returned to this appropriation. Notwithstanding ss. 20.001 (3) (a) and 20.002 (1), the
9department of health services may transfer funds between fiscal years under this
10paragraph. The department shall deposit into this appropriation funds it recovers
11under ss. 46.495 (2) (b) and 51.423 (15), from prior year audit adjustments including
12those resulting from audits of services under s. 46.26, 1993 stats., or s. 46.27. Except
13for amounts authorized to be carried forward under s. 46.45, all funds recovered
14under ss. 46.495 (2) (b) and 51.423 (15) and all funds allocated under s. 46.40 and not
15spent or encumbered by December 31 of each year shall lapse to the general fund on
16the succeeding January 1 unless carried forward to the next calendar year by the
17joint committee on finance.
AB40, s. 658 18Section 658. 20.435 (7) (hc) of the statutes is created to read:
AB40,416,2319 20.435 (7) (hc) Administration of the birth to 3 waiver program and the disabled
20children's long-term support program
. All monies received from counties under ss.
2146.99 (3) and (3m) and 46.995, for an entity to administer and to pay for services
22provided under the the birth to 3 waiver program under s. 46.99 and the disabled
23children's long-term support program, as defined in s. 46.011 (1g).
AB40, s. 659 24Section 659. 20.435 (7) (o) of the statutes is amended to read:

120.435 (7) (o) Federal aid; community aids. All federal moneys received in
2amounts pursuant to allocation plans developed by the department for the provision
3or purchase of services authorized under par. (b); all federal temporary assistance for
4needy families moneys received under 42 USC 601 to 619 that are authorized to be
5used to purchase or provide social services under 42 USC 1397 to 1397e , to be
6transferred to the appropriation account under s. 20.437 (1) (km)
; all unanticipated
7federal social services block grant funds received under 42 USC 1397 to 1397e, in
8accordance with s. 46.49 (2), to be transferred to the appropriation account under s.
920.437 (1) (km)
; and all federal moneys received under 42 USC 1396 to 1396v in
10reimbursement of the cost of preventing out-of-home placements of children, for
11distribution under s. 46.40. Disbursements from this appropriation may be made
12directly to counties for social and mental hygiene services under s. 46.03 (20) (b) or
1346.031 or directly to counties in accordance with federal requirements for the
14disbursal of federal funds.
AB40, s. 660 15Section 660. 20.435 (8) (mb) of the statutes is amended to read:
AB40,417,2516 20.435 (8) (mb) Income augmentation services receipts. All moneys that are
17received under 42 USC 1395 to 1395ddd and 42 USC 1396 to 1396v as the result of
18income augmentation activities for which the state has contracted, to be used as
19provided in s. 46.46; and all moneys that are received under 42 USC 1396 to 1396v
20in reimbursement of the cost of providing targeted case management services to
21children whose care is not eligible for reimbursement under 42 USC 670 to 679a, to
22be transferred to the appropriation account under s. 20.437 (3) (kp)
. All moneys
23received under this paragraph in excess of the moneys necessary to support the costs
24specified in s. ss. 46.46 and 48.567 shall be deposited in the general fund as a
25nonappropriated receipt.

1Section 661. 20.437 (1) (kb) of the statutes is created to read:
