2011 Senate RESOLUTION 6

SR6,1,2 Relating to: imposing penalties and costs on Senator Tim Cullen for being absent without leave.

SR6,1,4 Whereas, Senator Tim Cullen of the 15th Senate District has been absent without leave from the March 3, 2011, and March 4, 2011, session days; and

SR6,1,6 Whereas, Senate Rule 13n imposes penalties and costs on any member of the senate who is absent without leave for two or more session days; and

SR6,1,9 Whereas, pursuant to Senate Rule 13n, Senator Cullen has received notice by publication of both this resolution and the senate calendar which includes consideration of this resolution that he is subject to such penalties and costs; and

SR6,1,13 Whereas, the sergeant at arms has delivered a copy of both this resolution and the senate calendar which includes consideration of this resolution to Senator Cullen's senate office, thereby providing additional notice to the senator, pursuant to Senate Rule 13n; and

SR6,2,2 Whereas, pursuant to Senate Rule 13n, Senator Cullen has an opportunity to be heard, on the session day on which this resolution is before the senate, on the matter of whether or not penalties and costs for being absent without leave may be imposed on the senator; and

SR6,2,5 Whereas, upon adoption of this resolution, Senator Cullen is responsible for the penalties and costs imposed under Senate Rule 13n for each day that the senator is absent without leave; now, therefore, be it

SR6,2,11 Resolved by the senate, That pursuant to Senate Rule 13n, Senator Tim Cullen shall pay the penalties and costs imposed under Senate Rule 13n for being absent without leave for two or more session days and that the total amount of such penalties and costs shall be calculated by the senate chief clerk and submitted to the president who shall deliver that total, in writing, to Senator Tim Cullen's senate office for immediate payment.
