1995 WISCONSIN ACT 164
An Act to create 49.46 (2) (b) 1. hm. and im. of the statutes; relating to: removable and fixed prosthodontic services under medical assistance and making an appropriation.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
164,1 Section 1 . 49.46 (2) (b) 1. hm. and im. of the statutes are created to read:
49.46 (2) (b) 1. hm. Removable prosthodontic services.
im. Fixed prosthodontic services.
164,2 Section 2 . Nonstatutory provisions.
(1)   Amendment to the state plan under medical assistance. No later than 30 days after the effective date of this subsection, the department of health and social services shall submit to the federal department of health and human services an amendment to the state medical assistance plan to receive federal financial participation for services provided under section 49.46 (2) (b) 1. hm. and im. of the statutes, as created by this act, beginning on the earliest date permitted under federal law.
(2)   Retroactive payment for services received. No later than June 30, 1997, the department of health and social services shall make a payment to a provider under section 49.46 (2) (b) 1. hm. and im. of the statutes, as created by this act, for removable and fixed prosthodontic services performed during the period beginning on October 1, 1995, and ending on the effective date of this subsection if all of the following conditions are met:
(a)  If the patient paid the provider for the services, the provider provides proof to the department of health and social services that the provider has reimbursed the patient in full.
(b)  The provider agrees to accept payment for the services under the medical assistance program.
164,3 Section 3 . Appropriation changes.
(1)  Medical assistance. In the schedule under section 20.005 (3) of the statutes for the appropriation to the department of health and social services under section 20.435 (1) (b) of the statutes, as affected by the acts of 1995, the dollar amount is increased by $1,839,800 for fiscal year 1995-96 and the dollar amount is increased by $1,762,900 for fiscal year 1996-97 to fund increased medical assistance costs resulting from making payments for removable and fixed prosthodontic services.
164,4 Section 4 . Effective dates. This act takes effect retroactively to October 1, 1995, except as follows:
(1)  Amendment to the state plan under medical assistance. Section 2 (1) and (2 ) of this act takes effect on the day after publication.
