1An Act to create 941.236 of the statutes;
relating to: the manner of carrying
2firearms in cities and villages and providing a penalty.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

4941.236 Manner of carrying firearm in cities and villages. (1) In this
5section:

(a) "Correctional officer" has the meaning given in s. 941.237 (1) (b).

(b) "Encased" has the meaning given in s. 167.31 (1) (b).

(c) "Private security person" has the meaning given in s. 440.26 (1m).

(d) "Target range" has the meaning given in s. 941.237 (1) (f).

(e) "Unloaded" has the meaning given in s. 941.237 (1) (g).

11(2) No person may carry a firearm on his or her person within any city or village
12unless the firearm is unloaded and encased or unloaded and dismantled so as to
13render it inoperable.

14(3) Any person who violates sub. (2) is subject to a Class D forfeiture.

1(4) Subsection (2) does not apply to any of the following:

(a) A peace officer.

(b) A correctional officer while in the line of duty.

(c) A member of the U.S. armed forces or national guard while in the line of duty.

(d) A person duly authorized by the chief of police of the city or village or the
6chief of the capitol police to possess a firearm in a city or village in which the chief
7has jurisdiction.

(e) A private security person meeting all of the following criteria:

1. The private security person is covered by a license or permit issued under
10s. 440.26.

2. The private security person is in the line of duty.

(f) The authorized possession or use of a firearm at a public or private gun or
13sportsmen's club or public or private target range.

(g) The possession or use of a firearm on private property within the city or
15village, if the person possessing or using the firearm is authorized to do so by the
16property owner.

(h) The possession of an unloaded firearm by an individual who is traversing
18a public place within the city or village for the purpose of gaining access to public or
19private lands open to hunting.

(i) A person carrying a firearm while hunting in a place in which the city or
21village permits hunting.
