1An Act relating to: amending various provisions of the statutes for the purpose

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

(23) "State office" means the offices of governor, lieutenant governor,
6secretary of state, state treasurer, attorney general, s
ecretary of education state
7superintendent, justice of the supreme court, court of appeals judge, circuit court
8judge, state senator, state representative to the assembly and district attorney.
Note: Reinserts language unintentionally replaced by
1995 Wis. Act 27, section
9145 (1) (c). That section provides, with limited exceptions inapplicable to this provision,
that all references in the statutes to "state superintendent of public instruction" are
changed to "secretary of education". However: a) article X, section 1, of the constitution
requires the election of the state superintendent; b) section 177m of
1995 Wis. Act 27,
which creates the position of secretary of education, provides for filling that position by
appointment; and c) the Budget Analysis states that the secretary of education is
"nominated by the governor and appointed with the advice and consent of the senate".

(2) (a) There shall be one separate ballot for state superintendent, judicial
12officers, county executive under s. 59.031 and county supervisor. In counties having
13a population of 500,000 or more, the ballot also shall include those offices under s.
148.11 (2) and (2m). The arrangement of names of candidates for state superintendent,
15justice, court of appeals judge and circuit court judge shall be determined by the
16board in the manner specified in s. 5.60 (1) (b). Arrangement of the names of
17candidates for county executive and county supervisor shall be determined by the
18county clerk or by the executive director of the county board of election
19commissioners in the manner specified in s. 5.60 (1) (b). The ballot shall be titled
20"Official Ballot for
Secretary of Education State Superintendent of Public
21Instruction, Judicial, County Executive and County Supervisor Primary".
