SB36,1,2 An Act to create 450.11 (4) (a) 8. of the statutes; relating to: requiring the expiration date of a prescription drug to be included on the drug's label.

Analysis by the Legislative Reference Bureau

This bill requires a pharmacist or other practitioner who dispenses a prescription drug to include the expiration date of the drug on the label attached to the container in which the drug is dispensed. The expiration date on the label must be the manufacturer's expiration date, the date that is one year after the date on which the drug is dispensed or the date that the practitioner, in his or her professional judgment, determines to be the expiration date of the drug, whichever is earlier.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SB36, s. 1 Section 1. 450.11 (4) (a) 8. of the statutes is created to read:

SB36,1,9 450.11 (4) (a) 8. The expiration date of the prescribed drug dispensed. The expiration date that is indicated on the label by the pharmacist, physician, dentist, veterinarian or other dispensing practitioner shall be the manufacturer's expiration date of the drug, the date that is one year after the date on which the prescribed drug is dispensed, or the date that the practitioner, in his or her professional judgment, determines to be the expiration date of the drug, whichever is earlier.
