2commercial facilities or sites, the expansion or redevelopment of which is adversely
3affected by actual or perceived environmental contamination.
AB100-engrossed,1975,104 (b) "Brownfields redevelopment" means any work or undertaking by a person,
5municipality or local development corporation to acquire a brownfields facility or site
6and to raze, demolish, remove, reconstruct, renovate or rehabilitate the facility or
7existing buildings, structures or other improvements at the site for the purpose of
8promoting the use of the facility or site for commercial, industrial or other purposes.
9"Brownfields redevelopment" does not include construction of new facilities on the
10site for any purpose other than environmental remediation activities.
AB100-engrossed,1975,1511 (d) "Environmental remediation activities" means investigation, analysis and
12monitoring of a brownfields facility or site to determine the existence and extent of
13actual or potential environmental pollution; abating, removing or containing
14environmental pollution at a brownfields facility or site; or restoring soil or
15groundwater at a brownfields facility or site.
AB100-engrossed,1975,1716 (e) "Local development corporation" means a nonprofit corporation organized
17under ch. 181 that does all of the following:

AB100-engrossed,1975,2120 3. Demonstrates a commitment to or experience in the redevelopment of

AB100-engrossed,1975,2222 (f) "Municipality" means a city, village, town or county.
AB100-engrossed,1975,2423 (g) "Person" means an individual, partnership, corporation or limited liability
24company.

1(2) (a) Subject to subs. (4) and (5), from the appropriations under s. 20.143 (1)
2(br) and (qm) the department may make a grant to a person, municipality or local
3development corporation if all of the following apply:
AB100-engrossed,1976,54 1. The recipient uses the grant proceeds for brownfields redevelopment or
5associated environmental remediation activities.
AB100-engrossed,1976,86 2. All of the following are unknown, cannot be located or are financially unable
7to pay the cost of brownfields redevelopment or associated environmental
8remediation activities:
AB100-engrossed,1976,109 a. The party that caused the portion of the environmental contamination that
10is the basis for the grant request.
AB100-engrossed,1976,1211 b. Any person who possessed or controlled the environmental contaminant that
12is the basis for the grant request before the contaminant was released.
AB100-engrossed,1976,1313 3. The recipient contributes to the cost of the project as provided in par. (b).
AB100-engrossed,1976,1714 (b) 1. The contribution required under par. (a) 3. may be in cash or in-kind.
15Cash contributions may be of private or public funds, excluding funds obtained under
16the program under s. 560.17 or under any program under subch. V or VII of this
17chapter. In-kind contributions shall be limited to actual remediation services.
AB100-engrossed,1976,2318 2. For a grant that does not exceed $300,000, the recipient shall be required to
19contribute not less than 20% of the cost of the project. For a grant that is greater than
20$300,000 but that does not exceed $700,000, the recipient shall be required to
21contribute not less than 35% of the cost of the project. For a grant that is greater than
22$700,000 but that does not exceed $1,250,000, the recipient shall be required to
23contribute not less than 50% of the cost of the project.

25the following criteria:

7shall accord a 50% weight to the criterion under par. (a) 1., a 25% weight to the
8criterion under par. (a) 2., a 15% weight to the criterion under par. (a) 3. and a 10%
9weight to the criterion under par. (a) 4.

111997-98, and from the appropriation under s. 20.143 (1) (qm) in fiscal year 1998-99,

20in municipalities with a population of less than 30,000.
AB100-engrossed,1977,23 21(5) Before the department awards a grant under this section, the department
22shall consider the recommendations of the department of administration and the
23department of natural resources.

1(6) The department shall promulgate rules that establish criteria, within the
2guidelines under subs. (2) and (3), for awarding grants under this section, including
3the circumstances under which grant proceeds may be used for assessment services.

5shall submit a report on the effectiveness of the program under this section to the
6legislature under s. 13.172 (2) and to the governor and the department of
7administration.

AB100-engrossed,1979,5 3(2) Subject to subs. (3) and (4), the board may award a grant or loan for the
4purpose specified to any of the following entities located in an area affected by
5mining:
AB100-engrossed,1979,76 (a) A business, to finance costs associated with start-up, maintenance or
7expansion in an area affected by mining.
AB100-engrossed,1979,88 (b) A city, village, town or county, to develop an economic diversification plan.
AB100-engrossed,1979,119 (c) A city, village, town, county, community-based organization or local
10development corporation, to establish a local revolving loan fund to finance
11businesses that will create long-term employment opportunities.
AB100-engrossed,1979,1412 (d) A community-based organization or local development corporation, to
13conduct a local economic development project that will create long-term employment
14opportunities and to provide assistance to businesses or entrepreneurs.
AB100-engrossed,1979,1815 (e) A business, to obtain professional services related to the start-up,
16maintenance or expansion of the business, including assistance with feasibility
17studies or financial and marketing plans and managerial assistance after start-up
18or expansion.
AB100-engrossed,1979,20 19(3) The board may not award a grant or loan under sub. (2) if the proceeds will
20be used to establish or expand a business that is solely dependent on mining activity.
AB100-engrossed,1979,22 21(4) (a) The board may not award a grant or loan under sub. (2) (a), (b) or (d) that
22exceeds $100,000.

10dependence of the area on mining.

12shall make grants and loans awarded by the board under sub. (2).
AB100-engrossed,1980,18 13(7) The department, with the approval of the board, shall promulgate rules
14establishing policies and standards for awarding grants and loans under sub. (2),
15consistent with policies and standards established under the rules required under
16s. 560.602. The department shall promulgate rules regarding the application
17processes for grants and loans under sub. (2) and for loans made from revolving loan
18funds established with proceeds awarded under sub. (2) (c).
