SB33,1,3 1An Act to create 192.25 of the statutes; relating to: the minimum number of
2persons required on train crews, granting rule-making authority and
3providing a penalty.
Analysis by the Legislative Reference Bureau
Current law establishes minimum qualifications for railroad train conductors
and flagmen, but does not establish a minimum number of personnel necessary to
compose a train crew. This bill prohibits any railroad train or locomotive from
operating between terminals in this state unless the crew consists of at least 2
persons. The bill authorizes the office of the commissioner of railroads to grant
exceptions that will not endanger life or property.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB33, s. 1 4Section 1. 192.25 of the statutes is created to read:
SB33,1,8 5192.25 Railroad train crews. (1) No person operating or controlling any
6railroad, as defined in s. 85.01 (5), may allow the operation of any railroad train or
7locomotive between terminals in this state unless the railroad train or locomotive has
8a crew of at least 2 individuals.

1(2) The office may, by rule, grant an exception to sub. (1) if the office determines
2that the exception will not endanger the life or property of any person.
SB33,2,6 3(3) Any person who violates sub. (1) may be required to forfeit not less than $25
4nor more than $100 for a first offense, not less than $100 nor more than $500 for a
52nd offense committed within 3 years, and not less than $500 nor more than $1,000
6for a 3rd offense committed within 3 years.
