1999 WISCONSIN ACT 21
An Act to amend 961.14 (5) (ag) and 961.41 (3g) (f) of the statutes; relating to: the proper chemical name of the controlled substance gamma-butyrolactone (suggested as remedial legislation by the department of justice).
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
Law revision committee prefatory note: This bill is a remedial legislation proposal, requested by the department of justice and introduced by the law revision committee under s. 13.83 (1) (c) 4., stats. After careful consideration of the various provisions of the bill, the law revision committee has determined that this bill makes minor substantive changes in the statutes, and that these changes are desirable as a matter of public policy.
21,1 Section 1. 961.14 (5) (ag) of the statutes is amended to read:
961.14 (5) (ag) Gamma-hydroxybutyric acid (commonly known as gamma hydroxybutyrate or "GHB") and gamma-hydroxybutyrolactone gamma-butyrolactone.
21,2 Section 2. 961.41 (3g) (f) of the statutes is amended to read:
961.41 (3g) (f) If a person possesses or attempts to possess gamma-hydroxybutyric acid, gamma-hydroxybutyrolactone gamma-butyrolactone, ketamine or flunitrazepam, the person may be fined not more than $5,000 or imprisoned for not more than 2 years or both.
Note: This bill changes the drug name gamma-hydroxybutyrolactone to gamma-butyrolactone. Gamma-hydroxybutrolactone is a chemical that is not being abused nor is it likely to be abused. Gamma-butyrolactone is a chemical that is used in the manufacture of gamma-hydroxybutyrate and gamma-hydroxybutyric acid and is also a drug in its own right. Listing gamma-butyralactone in the statutes will enable prosecution of offenses involving this drug.
