1An Act to amend 961.14 (5) (ag) and 961.41 (3g) (f) of the statutes;
relating to:
2the proper chemical name of the controlled substance gamma-butyrolactone
3(suggested as remedial legislation by the department of justice).
Analysis by the Legislative Reference Bureau
Current law places various restrictions on controlled substances (dangerous
drugs). The legislature or the controlled substances board lists controlled substances
by chemical name in one of five schedules based on the substance's accepted medical
use and the potential for abuse of the substance. Among the controlled substances
currently placed in schedule I is a depressant that is listed by the incorrect chemical
name of "gamma-hydroxybutyrolactone". This bill corrects the chemical name to
read "gamma-butyrolactone".

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
Law revision committee prefatory note: This bill is a remedial legislation
proposal, requested by the department of justice and introduced by the law revision
committee under s. 13.83 (1) (c) 4., stats. After careful consideration of the various
provisions of the bill, the law revision committee has determined that this bill makes
minor substantive changes in the statutes, and that these changes are desirable as a
matter of public policy.

2. 961.41 (3g) (f) of the statutes is amended to read:

(3g) (f) If a person possesses or attempts to possess
7gamma-hydroxybutyric acid,
gamma-hydroxybutyrolactone 8gamma-butyrolactone, ketamine or flunitrazepam, the person may be fined not
9more than $5,000 or imprisoned for not more than 2 years or both.
Note: This bill changes the drug name gamma-hydroxybutyrolactone to
gamma-butyrolactone. Gamma-hydroxybutrolactone is a chemical that is not being
abused nor is it likely to be abused. Gamma-butyrolactone is a chemical that is used in
the manufacture of gamma-hydroxybutyrate and gamma-hydroxybutyric acid and is
also a drug in its own right. Listing gamma-butyralactone in the statutes will enable
prosecution of offenses involving this drug.
