SB203,15,18 (as) Upon the advice of the members of the licensure section who are clinical professional counselors, promulgate rules establishing minimum standards for educational programs that must be completed for licensure as clinical professional counselors under this chapter and approve educational programs in accordance with those standards.

SB203, s. 41 Section 41. 457.03 (1) (be), (bm) and (bs) of the statutes are created to read:

SB203,15,22 457.03 (1) (be) Upon the advice of the members of the licensure section who are clinical social workers, promulgate rules establishing a code of ethics to govern the professional conduct of clinical social workers.

SB203,15,25 (bm) Upon the advice of the members of the licensure section who are clinical marriage and family therapists, promulgate rules establishing a code of ethics to govern the professional conduct of clinical marriage and family therapists.

SB203,16,3 (bs) Upon the advice of the members of the licensure section who are clinical professional counselors, promulgate rules establishing a code of ethics to govern the professional conduct of clinical professional counselors.

SB203, s. 42 Section 42. 457.03 (1) (d) and (e) of the statutes are created to read:

SB203,16,8 457.03 (1) (d) Promulgate rules that specify the different levels of psychometric testing that an individual who is certified or licensed under this chapter is qualified to perform. A certificate holder or licensee may not engage in psychometric testing except as provided under the rules promulgated under this paragraph.

SB203,16,10 (e) Promulgate rules establishing the educational and practice requirements that are specified in ss. 457.08 (4) (c) 3., 457.10 (3) (c) and 457.12 (3) (a) 3. and (b) 3.

SB203, s. 43 Section 43. 457.03 (1) (f) of the statutes is created to read:

SB203,16,16 457.03 (1) (f) Study the need to allow other health care professionals to practice psychotherapy. If the examining board determines that there is a need for such authority, the examining board shall submit to the chief clerk of each house of the legislature for distribution to the appropriate standing committees under s. 13.172 (3) a report that includes any proposals for legislation.

SB203, s. 44 Section 44. 457.03 (2m) of the statutes is created to read:

SB203,16,20 457.03 (2m) The examining board may not promulgate rules under sub. (1) that permit an individual to engage in psychotherapy unless one of the following applies:

SB203,16,22 (a) The individual is licensed under this chapter as a clinical social worker, clinical marriage and family therapist or clinical professional counselor.

SB203,16,25 (b) The individual is certified as an advanced practice or independent social worker and the individual engages in psychotherapy only under the supervision of a clinical social worker who is licensed under this chapter.

SB203, s. 45 Section 45. 457.04 (1) to (4) of the statutes are amended to read:

SB203,17,5 457.04 (1) Use Designate himself or herself as a social worker or use or assume the title "social worker" or any other title or designation that represents or may tend to represent the person as a social worker unless the person is certified as a social worker under this chapter.

SB203,17,11 (2) Use Designate himself or herself as an advanced practice social worker or use or assume the title "advanced practice social worker" or any other title or designation that represents or may tend to represent the person as an advanced practice social worker unless the person is certified or licensed as an advanced practice social worker, independent social worker or independent clinical social worker under this chapter.

SB203,17,16 (3) Use Designate himself or herself as an independent social worker or use or assume the title "independent social worker" or any other title or designation that represents or may tend to represent the person as an independent social worker unless the person is certified or licensed as an independent social worker or independent clinical social worker under this chapter.

SB203,17,21 (4) Use Practice clinical social work or designate himself or herself as a clinical social worker or use or assume the title "independent clinical social worker" or "clinical social worker" or any other title or designation that represents or may tend to represent the person as a clinical social worker unless the person is certified licensed as an independent a clinical social worker under this chapter.

SB203, s. 46 Section 46. 457.04 (5) of the statutes is amended to read:

SB203,18,3 457.04 (5) Use Practice marriage and family therapy or designate himself or herself as a clinical marriage and family therapist or marriage and family therapist or use or assume the title "clinical marriage and family therapist", "marriage and family therapist", "marriage and family counselor" or any similar other title or designation that represents or may tend to represent the person as a clinical marriage and family therapist unless any of the following applies:

SB203,18,5 (a) The person is certified licensed as a clinical marriage and family therapist under this chapter.

SB203,18,8 (b) The person is certified licensed as an independent a clinical social worker under this chapter and initially became certified as an independent clinical social worker under this chapter ch. 457, 1997 stats., on or before May 31, 1995.

SB203, s. 47 Section 47. 457.04 (6) of the statutes is amended to read:

SB203,18,16 457.04 (6) Use Practice professional counseling or designate himself or herself as a clinical professional counselor or professional counselor or use or assume the title "clinical professional counselor", "professional counselor", "professional rehabilitation counselor", "vocational rehabilitation counselor" or, "rehabilitation counselor" or any similar other title or designation that represents or may tend to represent the person as a clinical professional counselor unless the person is certified licensed as a clinical professional counselor under this chapter.

SB203, s. 48 Section 48. 457.04 (7) of the statutes is created to read:

SB203,18,20 457.04 (7) Practice psychotherapy unless the person is licensed under this chapter or unless the person is a certificate holder who may practice psychotherapy under the rules promulgated under s. 457.03 (1) and (2m).

SB203, s. 49 Section 49. 457.06 (intro.) and (1) of the statutes are amended to read:

SB203,18,25 457.06 General requirements for certification or licensure. (intro.) The social worker section, marriage and family therapist section or professional counselor certification or licensure section may not grant any certificate or license under this chapter unless the applicant does all of the following:

SB203, s. 50 Section 50. 457.08 (title) of the statutes is amended to read:

SB203,19,5 457.08 (title) Social worker certificate and advanced practice certificates and licenses.

SB203,19,9 457.08 (1) Social worker certificate. (intro.) The social worker certification section shall grant a social worker certificate to an individual who qualifies under s. 457.09 (5) (d) or to any individual who does all of the following:

SB203,19,14 457.08 (1) (b) Submits evidence satisfactory to the social worker certification section that he or she has received a bachelor's or master's degree in social work from a program accredited by, or a preaccreditation program of, the council on social work education or a doctorate degree in social work.

SB203, s. 53 Section 53. 457.08 (1) (c) of the statutes is amended to read:

SB203,19,18 457.08 (1) (c) Passes an examination approved by the social worker certification section to determine minimum competence to practice as a social worker as specified in the rules promulgated under s. 457.03 (2) (1) (b).

SB203, s. 54 Section 54. 457.08 (2) (intro.) of the statutes is amended to read:

SB203,19,23 457.08 (2) Advanced practice social worker certificate. (intro.) The social worker certification section shall grant an advanced practice social worker certificate to any individual who is certified under sub. (1) and does all of the following:

SB203,20,4 457.08 (2) (b) Submits evidence satisfactory to the social worker certification section that he or she has received a master's degree in social work from a program accredited by, or a preaccreditation program of, the council on social work education or a doctorate degree in social work.

SB203,20,13 457.08 (3) Independent social worker certificate. (intro.) The social worker certification section shall grant an independent social worker certificate to any individual who is certified under sub. (1) and does all of the following:

SB203,20,18 457.08 (3) (b) Submits evidence satisfactory to the social worker certification section that he or she has received a master's degree in social work from a program accredited by, or a preaccreditation program of, the council on social work education or a doctorate degree in social work.

SB203, s. 59 Section 59. 457.08 (3) (c) of the statutes is amended to read:

SB203,20,23 457.08 (3) (c) Submits evidence satisfactory to the social worker certification section that after receiving a master's or doctorate degree in social work he or she has engaged in the equivalent of at least 2 years of full-time supervised social work practice approved by the social worker certification section.

SB203, s. 60 Section 60. 457.08 (3) (d) of the statutes is amended to read:

SB203,21,5 457.08 (3) (d) Passes an examination approved by the social worker certification section to determine minimum competence to practice as an independent social worker as specified in the rules promulgated under s. 457.03 (2) (1) (b) or passes the academy of certified social workers examination administered by the national association of social workers.

SB203, s. 61 Section 61. 457.08 (4) (intro.) of the statutes is amended to read:

SB203,21,10 457.08 (4) Independent clinical Clinical social worker certificate license. (intro.) The social worker licensure section shall grant an independent a clinical social worker certificate license to any individual who is certified under sub. (1) and does all of the following:

SB203, s. 62 Section 62. 457.08 (4) (b) of the statutes is amended to read:

SB203,21,17 457.08 (4) (b) Submits evidence satisfactory to the social worker licensure section that he or she has received a master's degree in social work from a program accredited by, or a preaccreditation program of, the council on social work education or a doctorate degree in social work and, as part of the master's or doctorate degree program, had a clinical social work concentration and completed supervised clinical field training.

SB203, s. 63 Section 63. 457.08 (4) (c) of the statutes is renumbered 457.08 (4) (c) (intro.) and amended to read:

SB203, s. 64 Section 64. 457.08 (4) (c) 1., 2. and 3. of the statutes are created to read:

SB203,22,4 2. An individual licensed as a clinical social worker who has engaged in the equivalent of 5 years of full-time clinical social work.

SB203,22,7 3. An individual licensed as a clinical social worker who satisfies educational or practice requirements that are comparable to the requirements under subd. 1. or 2. and that are established in rules promulgated under s. 457.03 (1) (e).

SB203, s. 65 Section 65. 457.08 (4) (d) of the statutes is amended to read:

SB203,22,13 457.08 (4) (d) Passes an examination approved by the social worker licensure section to determine minimum competence to practice as an independent a clinical social worker as specified in the rules promulgated under s. 457.03 (2) or passes an advanced a clinical social work examination approved by the social worker licensure section.

SB203, s. 66 Section 66. 457.09 (title) and (1) (intro.) and (a) of the statutes are amended to read:

SB203,22,18 457.09 (title) Social worker training certificate permit. (1) (intro.) The social worker certification section shall grant a social worker training certificate permit to any individual who does all of the following:

SB203,22,20 (a) Submits an application for the certificate permit to the department on a form provided by the department.

SB203, s. 67 Section 67. 457.09 (1) (c) of the statutes is amended to read:

SB203,22,25 457.09 (1) (c) Submits evidence satisfactory to the social worker certification section that he or she has a bachelor's degree from an accredited college or university in psychology, sociology, criminal justice or another human service program approved by the section.

SB203, s. 68 Section 68. 457.09 (1) (d) of the statutes is amended to read:

SB203,23,4 457.09 (1) (d) Submits a statement to the social worker certification section that he or she is seeking to attain social worker degree equivalency under sub. (4) while he or she holds a social worker training certificate permit.

SB203, s. 69 Section 69. 457.09 (2) of the statutes is amended to read:

SB203,23,8 457.09 (2) (a) A Notwithstanding s. 457.04 (1), a social worker training certificate permit authorizes the holder to use the title specified in s. 457.04 (1) during the period in which the certificate permit is valid.

SB203,23,11 (b) A social worker training certificate permit holder is a social worker certified under this chapter for purposes of any law governing social workers certified under this chapter.

SB203, s. 70 Section 70. 457.09 (3) of the statutes is amended to read:

SB203,23,14 457.09 (3) (a) Except as provided in par. (b), a social worker training certificate permit is valid for 24 months.

SB203,23,18 (b) A social worker training certificate permit shall expire on the date on which the certificate permit holder receives the results of the examination that he or she has taken under sub. (5) (a) if that date occurs before the end of the period specified in par. (a).

SB203,23,19 (c) A social worker training certificate permit may not be renewed.

SB203, s. 71 Section 71. 457.09 (4) (intro.) of the statutes is amended to read:

SB203,23,22 457.09 (4) (intro.) During the period in which a social worker training certificate permit is valid, the certificate permit holder shall do all of the following:

SB203, s. 72 Section 72. 457.09 (4m) of the statutes is amended to read:

SB203,24,2 457.09 (4m) (a) The social worker certification section shall determine whether a course, internship or employment satisfies the requirements under sub. (4) and whether a social worker training certificate permit holder has attained social worker degree equivalency.

SB203,24,9 (b) Notwithstanding sub. (4), for the purpose of determining whether a social worker training certificate permit holder has attained social worker degree equivalency under sub. (4), the section shall apply course work or internships that the certificate permit holder completed, or employment that the certificate permit holder held, as part of the program leading to the degree that he or she specified to satisfy the requirement in sub. (1) (c) if the course work, internship or employment satisfies the requirements in sub. (4).

SB203, s. 73 Section 73. 457.09 (5) of the statutes is amended to read:

SB203,24,13 457.09 (5) (a) A social worker training certificate permit holder may take the national social work examination at any time after he or she completes the requirements under sub. (4).

SB203,24,17 (b) If a social worker training certificate permit holder passes the examination specified under par. (a), he or she shall be permitted to take an examination approved by the social worker certification section that tests knowledge of state law relating to social work.

SB203,24,21 (c) If an individual fails an examination specified under par. (a) or (b), he or she may retake the examination. The social worker certification section may not place any restrictions on the number of times an individual may retake the examinations specified under pars. (a) and (b).

SB203,24,24 (d) The social worker certification section shall grant a social worker certificate to an individual who has held a social worker training certificate permit and who passes the examinations specified under pars. (a) and (b).
