611.255 Prior approval of certain expenditures required. (1) In this
7subsection, "independent expenditure" means an expenditure made for the purpose
8of making a communication that is made during the period beginning on the 90th day
9preceding any primary or other election; that contains the name or likeness of a
10clearly identified candidate at that election; that is made without cooperation or
11consultation with such a candidate, or any authorized committee or agent of such a
1candidate; and that is not made in concert with, or at the request or suggestion of,
2such a candidate, or any authorized committee or agent of such a candidate.

3(2) No person may make any independent expenditure unless the person first
4submits the proposed text of the communication to be financed by the expenditure
5to the board and the board approves the communication. Upon receipt of the text of
6a proposed communication under this subsection, the board shall transmit a copy of
7the communication to each individual who is a candidate for the office or offices
8contested at the election to which the communication relates. Any candidate who
9receives a copy of the communication may file written objections to the
10communication with the board within 3 days of the date of transmittal alleging that
11the proposed communication contains factual information that is false or grossly
12misleading. If the board finds that the proposed communication does not contain any
13factual information that is false or grossly misleading, it shall approve the proposed
14communication. Otherwise, the board shall disapprove the proposed communication
15and promptly transmit to the person who submitted it a statement of the board's
16objections.".
