2005 WISCONSIN ACT 481
An Act to amend 23.33 (2j) (e), 30.52 (2), 30.52 (3) (a) and 350.12 (3j) (d); and to create 23.33 (2) (b) 3m., 30.52 (3g) and 350.12 (2) (d) of the statutes; relating to: exempting from registration and trail sticker requirements snowmobiles and all-terrain vehicles that are used in certain advertisements, certificates of number issued for boats which are used in certain advertisements, and requiring the exercise of rule-making authority.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
481,1 Section 1. 23.33 (2) (b) 3m. of the statutes is created to read:
23.33 (2) (b) 3m. Present in this state, for a period not to exceed 15 days, and if it is used exclusively as part of an advertisement being made for the manufacturer of the all-terrain vehicle.
481,2 Section 2. 23.33 (2j) (e) of the statutes is amended to read:
23.33 (2j) (e) An all-terrain vehicle that is registered under sub. (2) (a) or that is exempt from registration under sub. (2) (b) 1., 3., 3m., or 4. is exempt from having a nonresident trail pass displayed as required under par. (b). The department may promulgate a rule to exempt all-terrain vehicles that are exempt from registration under sub. (2) (b) 5. from having nonresident trail passes displayed as required under par. (b) or may promulgate a rule to exempt owners of such all-terrain vehicles from having to pay any applicable nonresident trail pass fee.
481,3m Section 3m. 30.52 (2) of the statutes is amended to read:
30.52 (2) Certification and registration period. The Except as provided in sub. (3g), the certification and registration period runs for 3 years, commencing on April 1 of the year in which the certificate of number or registration is issued and, unless sooner terminated or discontinued in accordance with this chapter, expiring on March 31 of the 3rd year after issuance. A certificate of number or registration is valid only for the period for which it is issued.
481,4m Section 4m. 30.52 (3) (a) of the statutes is amended to read:
30.52 (3) (a) Payment of fee required. A Except as provided in sub. (3g), a person who applies for the issuance or renewal of a certificate of number or registration shall pay the department the fee required under this subsection for the whole or any part of a certification and registration period.
481,5m Section 5m. 30.52 (3g) of the statutes is created to read:
30.52 (3g) Exemption. (a) A boat that is present in this state and used exclusively as part of an advertisement being made for the manufacturer of the boat shall be issued a certificate of number for a period not to exceed 15 days. The department may not charge a fee for the issuance of a certificate of number under this paragraph.
(b) The department shall promulgate rules for the issuance of certificates of number under par. (a).
481,6 Section 6. 350.12 (2) (d) of the statutes is created to read:
350.12 (2) (d) Present in this state, for a period not to exceed 15 days, and if it is used exclusively as part of an advertisement being made for the manufacturer of the snowmobile.
481,7 Section 7. 350.12 (3j) (d) of the statutes is amended to read:
350.12 (3j) (d) A snowmobile that is registered under this section or that is exempt from registration under sub. (2) (a) or (d) is exempt from having a trail use sticker displayed under par. (a).
