SB288-SSA1,4,1514 1. A purpose of the trial is to test whether the intervention potentially improves
15the trial participant's health outcomes.
SB288-SSA1,4,1716 2. The treatment provided as part of the trial is given with the intention of
17improving the trial participant's health outcomes.
SB288-SSA1,4,1918 3. The trial has therapeutic intent and is not designed exclusively to test
19toxicity or disease pathophysiology.
SB288-SSA1,4,2020 4. The trial does one of the following:
SB288-SSA1,4,2221 a. Tests how to administer a health care service, item, or drug for the treatment
22of cancer.
SB288-SSA1,4,2423 b. Tests responses to a health care service, item, or drug for the treatment of
24cancer.
SB288-SSA1,5,3
1c. Compares the effectiveness of health care services, items, or drugs for the
2treatment of cancer with that of other health care services, items, or drugs for the
3treatment of cancer.
SB288-SSA1,5,54 d. Studies new uses of health care services, items, or drugs for the treatment
5of cancer.
SB288-SSA1,5,66 5. The trial is approved by one of the following:
SB288-SSA1,5,87 a. A National Institute of Health, or one of its cooperative groups or centers,
8under the federal department of health and human services.
SB288-SSA1,5,99 b. The federal food and drug administration.
SB288-SSA1,5,1010 c. The federal department of defense.
SB288-SSA1,5,1111 d. The federal department of veterans affairs.
SB288-SSA1,5,1312 (d) 1. The coverage that may not be excluded under this subsection shall apply
13to all phases of a cancer clinical trial.
SB288-SSA1,5,1814 2. The coverage that may not be excluded under this subsection is subject to
15all terms, conditions, restrictions, exclusions, and limitations that apply to any other
16coverage under the policy, plan, or contract, including the treatment under the policy,
17plan, or contract of services performed by participating and nonparticipating
18providers.
SB288-SSA1,5,2119 (e) 1. Nothing in the subsection requires a policy, plan, or contract to offer; or
20prohibits a policy, plan, or contract from offering; cancer clinical trial services by a
21participating provider.
SB288-SSA1,5,2522 2. Nothing in this subsection requires services that are performed in a cancer
23clinical trial by a nonparticipating provider of a policy, plan, or contract to be
24reimbursed at the same rate as a participating provider of the policy, plan, or
25contract.

1Section 11. Initial applicability.
SB288-SSA1,6,22 (1) This act first applies to all of the following:
SB288-SSA1,6,53 (a) Except as provided in paragraphs (b) and (c), disability insurance policies
4that are issued or renewed, and self-insured health plans that are established,
5extended, modified, or renewed, on the effective date of this paragraph.
SB288-SSA1,6,86 (b) Disability insurance policies covering employees who are affected by a
7collective bargaining agreement containing provisions inconsistent with this act
8that are issued or renewed on the earlier of the following:
SB288-SSA1,6,9 91. The day on which the collective bargaining agreement expires.
SB288-SSA1,6,11 102. The day on which the collective bargaining agreement is extended, modified,
11or renewed.
SB288-SSA1,6,1412 (c) Self-insured health plans covering employees who are affected by a
13collective bargaining agreement containing provisions inconsistent with this act
14that are established, extended, modified, or renewed on the earlier of the following:
SB288-SSA1,6,15 151. The day on which the collective bargaining agreement expires.
SB288-SSA1,6,17 162. The day on which the collective bargaining agreement is extended, modified,
17or renewed.

SB288-SSA1,6,2019 (1) This act takes effect on the first day of the 7th month beginning after
20publication.
