SECTION 4. 973.09 (1) (a) of the statutes is amended to read:

973.09 (1) (a) Except as provided in par. (c) or if probation is prohibited for a particular offense by statute, if a person is convicted of a crime, the court, by order, may withhold sentence or impose sentence under s. 973.15 and stay its execution, and in either case place the person on probation to the department for a stated period, stating in the order the reasons therefor. The court may impose any conditions which appear to be reasonable and appropriate. The period of probation may be made consecutive to a sentence on a different charge, whether imposed at the same time or previously. If the court imposes an increased term of probation, as authorized under sub. (2) (a) 2. or (b) 2. or s. 939.621 (3), it shall place its reasons for doing so on the record.

SECTION 5. 973.09 (2) (a) 1. of the statutes is amended to read:

973.09 (2) (a) 1. Except as provided in subd. 2. and s. 939.621 (3), for Class A misdemeanors, not less than 6 months nor more than 2 years one year.

SECTION 6. 973.09 (2) (a) 1m. of the statutes is created to read:

973.09 (2) (a) 1m. Except as provided in subd. 2. and s. 939.621 (3), for misdemeanors not covered by subd. 1., not more than 6 months.

Under current law, DOT, in consultation with the Wisconsin Coastal Management Council, administers a Harbor Assistance Program. Under the program, an eligible applicant may be awarded a grant to partially reimburse the applicant for expenses incurred in making certain harbor improvements. Eligible applicants include counties, cities, villages, towns, boards of harbor commissioners, and, with limitations, owners of a private harbor facility. DOT may contract up to $28,000,000 in public debt (general obligation bonds) to provide grants for harbor improvements.
This bill requires DOT to award a grant, from general obligation bond proceeds, of $6,000,000 to a city in northeastern Wisconsin that has a harbor facility for the purpose of constructing new boatlift facilities or improving existing boatlift facilities that serve or will serve at least two commercial enterprises that enhance economic development and will provide at least 600 new jobs in this state. This bill also requires DOT to award a grant, from general obligation bond proceeds, of $2,100,000 for a boat slip repair and reconstruction project in northeastern Wisconsin if the project is necessary to retain at least 2,500 jobs in this state.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
SECTION 9148. Nonstatutory provisions; transportation.

(1) HARBOR ASSISTANCE PROGRAM.

(a) Notwithstanding any limitation specified in section 85.095 (2) (a) or (b) of the statutes, from the appropriation under section 20.866 (2) (uv) of the statutes, the department of transportation shall award a grant under section 85.095 (2) (a) of the statutes of $6,000,000 in the 2005-07 fiscal biennium to a city in northeastern Wisconsin that has a harbor facility for the purpose of constructing new boatlift facilities or improving existing boatlift facilities that serve or will serve at least 2 commercial enterprises that enhance economic development and will provide at lease 600 new jobs in this state.

(b) Notwithstanding any limitation specified in section 85.095 (2) (a) or (b) of the statutes, from the appropriation under section 20.866 (2) (uv) of the statutes, the department of transportation shall award a grant under section 85.095 (2) (a) of the statutes of $2,100,000 in the 2005-07 fiscal biennium for a boat slip repair and reconstruction project in northeastern Wisconsin if the project is necessary to retain at least 2,500 jobs in this state.

Under current law, DOT collects a supplemental vehicle title fee of $7.50 in connection with applications for certificates of title for new vehicles and for vehicles the ownership of which has been transferred. The Department of Commerce (Commerce) also collects a supplemental manufactured home title fee of $7.50 in connection with applications for certificates of title for new manufactured homes and for manufactured homes the ownership of which has been transferred. These two supplemental title fees are deposited into the transportation fund. By October 1 of each year, the secretary of transportation must certify to the secretary of administration the amount of these two supplemental title fees collected during the previous fiscal year and that amount, minus $555,000, is transferred from the general fund to the environmental fund on October 1 of each year.
Under this bill, this transfer mechanism is eliminated and these two supplemental title fees are deposited directly into the environmental fund for nonpoint source water pollution abatement. The bill includes provisions ensuring that the impact of this change will occur as of July 1, 2005.
