Under current law, DOT collects a supplemental vehicle title fee of $7.50 in connection with applications for certificates of title for new vehicles and for vehicles the ownership of which has been transferred. The Department of Commerce (Commerce) also collects a supplemental manufactured home title fee of $7.50 in connection with applications for certificates of title for new manufactured homes and for manufactured homes the ownership of which has been transferred. These two supplemental title fees are deposited into the transportation fund. By October 1 of each year, the secretary of transportation must certify to the secretary of administration the amount of these two supplemental title fees collected during the previous fiscal year and that amount, minus $555,000, is transferred from the general fund to the environmental fund on October 1 of each year.
Under this bill, this transfer mechanism is eliminated and these two supplemental title fees are deposited directly into the environmental fund for nonpoint source water pollution abatement. The bill includes provisions ensuring that the impact of this change will occur as of July 1, 2005.

SECTION 1. 20.292 (1) (fc) of the statutes is renumbered 20.292 (1) (u) and amended to read:

20.292 (1) (u) Driver education, local assistance. The From the transportation fund, the amounts in the schedule, to be distributed to technical college districts for operating driver training programs under s. 38.28 (2) (c) and (g).

SECTION 6. 20.370 (7) (mc) of the statutes is renumbered 20.370 (7) (mr) and amended to read:

20.370 (7) (mr) Resource maintenance and development -- state park, forest and riverway roads. As a continuing appropriation from the transportation fund, the amounts in the schedule for state park and forest roads and roads in the lower Lower Wisconsin state riverway State Riverway as defined in s. 30.40 (15) under s. 84.28 and for the maintenance of roads in state parks under ch. 27 and recreation areas in state forests under ch. 28 which are not eligible for funding under s. 84.28. The department may expend up to $400,000 from this appropriation in each fiscal year for state park and forest roads and roads in the lower Lower Wisconsin state riverway State Riverway as defined in s. 30.40 (15) under s. 84.28 and shall expend the balance from the appropriation for the maintenance of roads which are not eligible for funding under s. 84.28.

SECTION 16. 25.40 (1) (fm) of the statutes is amended to read:

25.40 (1) (fm) All moneys received as fees under s. 101.9208 (1), except fees received under s. 101.9208 (1) (b) and (dm).

SECTION 17. 25.46 (1m) of the statutes is amended to read:

25.46 (1m) The moneys transferred under s. 20.855 (4) (f) fees imposed under ss. 101.9208 (1) (dm) and 342.14 (3m) for nonpoint source water pollution abatement.

SECTION 18. 38.28 (3) of the statutes is amended to read:

38.28 (3) If the appropriation for state aid under s. 20.292 (1) (fc) (u) in any one year is insufficient to pay the full amount under subs. (2) (c) and (g), funds in the appropriation shall be used first for the purposes of sub. (2) (c) and any remaining funds shall be prorated among the districts entitled to support under sub. (2) (g). If the appropriation for state aid under s. 20.292 (1) (fc) (u) in any one year is insufficient to pay the full amount under sub. (2) (c), funds in the appropriation shall be prorated among the districts entitled to the funds.

SECTION 19. 38.29 (2) (c) of the statutes is amended to read:

38.29 (2) (c) Amounts awarded shall be paid from the appropriation under s. 20.292 (1) (fg) (v).

SECTION 20. 84.28 (1) of the statutes is amended to read:

84.28 (1) Moneys from the appropriation under s. 20.370 (7) (mc) (mr) may be expended for the renovation, marking and maintenance of a town or county highway located within the boundaries of any state park, state forest or other property under the jurisdiction of the department of natural resources. Moneys from the appropriation under s. 20.370 (7) (mc) (mr) may be expended for the renovation, marking and maintenance of a town or county highway located in the lower Lower Wisconsin state riverway State Riverway as defined in s. 30.40 (15). Outside the lower Lower Wisconsin state riverway State Riverway as defined in s. 30.40 (15), or outside the boundaries of these parks, forests or property, moneys from the appropriation under s. 20.370 (7) (mc) (mr) may be expended for the renovation, marking and maintenance of roads which the department of natural resources certifies are utilized by a substantial number of visitors to state parks, state forests or other property under the jurisdiction of the department of natural resources. The department of natural resources shall authorize expenditures under this subsection. The department of natural resources shall rank projects eligible for assistance under a priority system and funding may be restricted to those projects with highest priority.

SECTION 21. 85.037 of the statutes is repealed.

SECTION 22. 101.9208 (1) (dm) of the statutes is amended to read:

101.9208 (1) (dm) Upon filing an application under par. (a) or (d), a supplemental title fee of $7.50 by the owner of the manufactured home, except that this fee shall be waived with respect to an application under par. (d) for transfer of a decedent's interest in a manufactured home to his or her surviving spouse. The fee specified under this paragraph is in addition to any other fee specified in this section. The department shall deposit into the environmental fund all fees collected under this paragraph.

SECTION 23. 146.55 (4) (a) of the statutes is amended to read:

146.55 (4) (a) From the appropriation under s. 20.435 (5) (ch) (rb), the department shall annually distribute funds for ambulance service vehicles or vehicle equipment, emergency medical services supplies or equipment or emergency medical training for personnel to an ambulance service provider that is a public agency, a volunteer fire department or a nonprofit corporation, under a funding formula consisting of an identical base amount for each ambulance service provider plus a supplemental amount based on the population of the ambulance service provider's primary service or contract area, as established under s. 146.50 (5).

SECTION 24. 146.58 (8) of the statutes is amended to read:

146.58 (8) Review the annual budget prepared by the department for the expenditures under s. 20.435 (5) (ch) (rb).

SECTION 25. 166.03 (2) (a) 5. of the statutes is amended to read:

166.03 (2) (a) 5. Provide assistance to the Wisconsin wing of the civil air patrol from the appropriation under s. 20.465 (3) (f) (y) for the purpose of enabling the patrol to perform its assigned missions and duties as prescribed by U.S. air force regulations. Expenses eligible for assistance are aircraft acquisition and maintenance, communications equipment acquisition and maintenance and office staffing and operational expenses. The civil air patrol shall submit vouchers for expenses eligible for assistance to the division.

SECTION 26. 166.215 (1) of the statutes is amended to read:

166.215 (1) Beginning July 1, 2001, the division shall contract with no more than 9 regional emergency response teams, one of which shall be located in La Crosse County. Each regional emergency response team shall assist in the emergency response to level A releases in a region of this state designated by the division. The division shall contract with at least one regional emergency response team in each area designated under s. 166.03 (2) (b) 1. The division may only contract with a local agency, as defined in s. 166.22 (1) (c), under this subsection. A member of a regional emergency response team shall meet the standards for a hazardous materials specialist in 29 CFR 1910.120 (q) (6) (iv) and national fire protection association standards NFPA 471 and 472. Payments to regional emergency response teams under this subsection shall be made from the appropriation account under s. 20.465 (3) (dd) (u).

SECTION 27. 166.215 (2) of the statutes is amended to read:

166.215 (2) The division shall reimburse a regional emergency response team for costs incurred by the team in responding to an emergency involving a level A release, or a potential level A release, if the team followed the procedures in the rules promulgated under s. 166.20 (2) (bs) 1. to determine if an emergency requiring a response existed. Reimbursement under this subsection is limited to amounts collected under sub. (3) and the amounts appropriated under s. 20.465 (3) (dr) (x). Reimbursement is available under s. 20.465 (3) (dr) (x) only if the regional emergency response team has made a good faith effort to identify the person responsible under sub. (3) and that person cannot be identified, or, if that person is identified, the team has received reimbursement from that person to the extent that the person is financially able or has determined that the person does not have adequate money or other resources to reimburse the regional emergency response team.

SECTION 28. 166.22 (3m) of the statutes is amended to read:

166.22 (3m) The division shall reimburse a local emergency response team for costs incurred by the team in responding to an emergency involving a hazardous substance release, or potential release, if the team followed the procedures in the rules promulgated under s. 166.20 (2) (bs) 2. to determine if an emergency requiring the team's response existed. Reimbursement under this subsection is limited to the amount appropriated under s. 20.465 (3) (dr) (x). Reimbursement is available under s. 20.465 (3) (dr) (x) only if the local emergency response team has made a good faith effort to identify the person responsible under sub. (4) and that person cannot be identified, or, if that person is identified, the team has received reimbursement from that person to the extent that the person is financially able or has determined that the person does not have adequate money or other resources to reimburse the local emergency response team.

SECTION 29. 342.14 (3m) of the statutes is amended to read:

342.14 (3m) Upon filing an application under sub. (1) or (3), a supplemental title fee of $7.50 by the owner of the vehicle, except that this fee shall be waived with respect to an application under sub. (3) for transfer of a decedent's interest in a vehicle to his or her surviving spouse. The fee specified under this subsection is in addition to any other fee specified in this section. The department shall deposit into the environmental fund all fees collected under this subsection.

SECTION 9148. Nonstatutory provisions; transportation.

(1) TRANSFER OF SUPPLEMENTAL TITLE FEES.

(a) No transfer of moneys may be made under section 20.855 (4) (f), 2003 stats., on or after the effective date of this paragraph.

(b) If the effective date of this paragraph is after October 1, 2005, the secretary of administration shall transfer, in fiscal year 2005-06, from the environmental fund to the general fund an amount equal to the amount transferred under section 20.855 (4) (f), 2003. stats., from the general fund to the environmental fund between July 1, 2005, and the effective date of this paragraph.

(c) If the effective date of this paragraph is after July 1, 2005, the secretary of transportation shall, no later than 60 days after the effective date of this paragraph, certify to the secretary of administration the amount of fees collected under sections 101.9208 (1) (dm), 2003 stats., and 342.14 (3m), 2003 stats., and deposited into the transportation fund between July 1, 2005, and the effective date of this paragraph, and the secretary of administration shall transfer, in fiscal year 2005-06, this amount from the transportation fund to the environmental fund.

Current law requires a school board annually to publish a summary of its proposed budget before it holds a public hearing on the budget. This bill requires the summary to include, for the proposed budget, the current budget, and the budget in the previous fiscal year, the school district's general fund balance at the end of the fiscal year divided by the school district's general fund expenditures in that fiscal year, expressed as a percentage. The budget summary must also include, for the current and previous fiscal years, the statewide average school district general fund balance at the end of the fiscal year divided by the statewide average school district general fund expenditures in that fiscal year, expressed as a percentage.
The bill also provides that if a school board adopts a proposed budget in which the school district's general fund balance at the end of the fiscal year divided by the school district's general fund expenditures in that fiscal year will exceed an amount equal to 90 percent of the statewide average school district general fund ratio of balance to expenditures in the previous fiscal year, the school board must approve the excess by a separate vote.
