AB1079,1,3 1An Act to amend 23.33 (4) (c) (title); and to create 23.33 (4) (c) 3. and 23.33 (11)
2(ag) of the statutes; relating to: allowing all-terrain vehicles on highways for
3the purpose of plowing snow.
Analysis by the Legislative Reference Bureau
Under current law, no person may operate an all-terrain vehicle upon any part
of any freeway that is a part of the federal system of interstate and defense highways
or upon any part of any other highway except for limited operations such as crossing
a highway between trails. There are limited exceptions that allow a person to
operate an all-terrain vehicle on a closed highway during a special event or for
certain municipal, state, and utility operations.
This bill allows a county, town, city, or village to allow a person to operate an
all-terrain vehicle on a highway for the purpose of removing snow. In order to
operate an all-terrain vehicle on a highway, a person must have a snowplow attached
to his or her all-terrain vehicle and there must be an accumulation of snow on the
ground.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

AB1079, s. 2 3Section 2. 23.33 (4) (c) 3. of the statutes is created to read:
AB1079,2,64 23.33 (4) (c) 3. Paragraph (b) does not apply to the operator of an all-terrain
5vehicle who is engaged in snow removal in a county, town, city, or village that has
6passed an ordinance under sub. (11) (ag).
AB1079, s. 3 7Section 3. 23.33 (11) (ag) of the statutes is created to read:
AB1079,2,128 23.33 (11) (ag) A county, town, city, or village may enact an ordinance that
9allows a person to operate an all-terrain vehicle on a highway for the purpose of
10removing snow. An ordinance enacted under this subsection may allow the operation
11of an all-terrain vehicle on a highway only when there is accumulated snowfall on
12the ground and only if the all-terrain vehicle has an attached snowplow.
