ASSEMBLY AMENDMENT 1, TO 2007 ASSEMBLY BILL 341

AB341-AA1,1,1 At the locations indicated, amend the bill as follows:

AB341-AA1,1,2 1. Page 3, line 1: delete lines 1 to 5.

AB341-AA1,1,3 2. Page 4, line 1: delete lines 1 to 15 and substitute:

AB341-AA1,1,4 " Section 3m. 66.0617 (6) (g) of the statutes is amended to read:

AB341-AA1,1,7 66.0617 (6) (g) Shall be payable by the developer or the property owner to the municipality in full within 14 days of upon the issuance of a building permit or within 14 days of the issuance of an occupancy permit by the municipality.".

AB341-AA1,1,8 3. Page 4, line 17: delete " and (c)" and substitute ", (c), and (d)".

AB341-AA1,1,12 4. Page 4, line 19: delete lines 19 and 20 and substitute "specify that impact fees that are imposed and collected by a municipality within 7 years of the effective date of the ordinance, but are not used within 7 10 years after they are collected the effective date of the ordinance to pay the capital costs for which they".

AB341-AA1,1,13 5. Page 4, line 21: delete "imposed" and substitute "imposed,".

AB341-AA1,2,1 6. Page 5, line 23: after that line insert:

AB341-AA1,2,2 " Section 6e. 66.0617 (9) (d) of the statutes is created to read:

AB341-AA1,2,9 66.0617 (9) (d) With regard to an impact fee that is collected after April 10, 2006, and that is collected more than 7 years after the effective date of the ordinance, such impact fees shall be used within a reasonable period of time after they are collected to pay the capital costs for which they were imposed, or they shall be refunded to the current owner of the property with respect to which the impact fees were imposed, along with any interest that has accumulated, as described in sub. (8).".

AB341-AA1,2,11 7. Page 6, line 6: delete lines 6 and 7 and substitute "rate customarily paid for similar services by the political subdivision.".

AB341-AA1,2,14 8. Page 7, line 15: delete that line and substitute "or other real or personal property, except that a municipality or town may impose a fee or other charge to fund the acquisition or initial improvement of land".

AB341-AA1,2,15 9. Page 7, line 19: delete "initial".

AB341-AA1,2,16 10. Page 7, line 24: before "improvement" insert "initial".

AB341-AA1,2,17 11. Page 8, line 2: before " improvement fee" insert "initial".
