I am directed to inform you that the Assembly has adopted and asks concurrence in:
Committee of Conference report on Senate Bill 40 (Conference Substitute Amendment 1).

Senator Robson, with unanimous consent, asked that the Committee of Conference report on Senate Bill 40 be taken up at this time.

Relating to: state finances and appropriations, constituting the executive budget act of the 2007 legislature.
The question was: Shall the Committee of Conference report on Senate Bill 40 be concurred in?
The ayes and noes were required and the vote was: ayes, 18; noes, 15; absent or not voting, 0; as follows:

Senator Robson, with unanimous consent, asked that all action be immediately messaged to the Assembly.

Senator Wirch, with unanimous consent, asked that when the Senate adjourn, it do so in honor of Don Robers who has volunteered 417 hours for literacy training.

Senator Risser, with unanimous consent, asked that when the Senate adjourn, it do so in honor of Dr. Daniel Eimermann who died Saturday, September 15, 2007 during the swim portion of the Devil's Challenge triathlon at Devil's Lake State Park. Dan was a model of health and fitness and his death was a shock to all who knew him. Dan was a respected and caring physician, a devoted father of his two daughters Sara and Anne, and dedicated husband of Molly Kelley. He was a greatly loved and respected man who will be missed by all.
Senator Lassa, with unanimous consent, asked that when the Senate adjourn, it do so in honor of Lester Searle who recently passed away. He was a good neighbor who will be missed by his friends and family.
