AB474,9,15 2. Subject to pars. (b), (c), and (d) and sub. (2) (a), upon a request under sub. (2), each law enforcement agency shall design a certification card to be issued by the law enforcement agency under sub. (2) (a).

AB474,9,16 (b) A certification card shall contain on one side all of the following:

AB474,9,18 1. The full name, date of birth, and residence address of the person who holds the certification card.

AB474,9,20 2. A photograph of the certification card holder and a physical description that includes sex, height, weight, and hair and eye color.

AB474,9,21 3. The name of this state.

AB474,9,25 (c) A certification card shall include a statement that the certification card does not confer any law enforcement authority on the certification card holder and does not make the certification card holder an employee or agent of the certifying agency or department.

AB474,10,2 (d) A certification card may not contain the certification card holder's social security number.

AB474,10,12 (5) Renewal of certification cards. A person who holds a current certification card issued under sub. (2) or (3) may renew the certification card by requesting the department or the law enforcement agency, whichever issued the current certification card, to renew the certification card, if, before the date the certification card expires, the law enforcement agency verifies sub. (2) (b) 5. and 6., if the certification card holder is a retired officer, or the department verifies sub. (3) (b) 5. and 6., if the certification card holder is a retired federal officer, and the certification card holder provides any information necessary for the verification. The renewal shall state the date on which verification was made and an expiration date that is 12 months later than that date.

AB474,10,15 (6) Immunity. (a) When acting in good faith under this section, the department and its employees and a law enforcement agency and its employees are immune from civil and criminal liability arising from any act or omission under this section.

AB474,10,19 (b) When acting in good faith under this section, an entity providing firearms training to comply with the requirements under sub. (2) (a) 2., (3) (a) 2., or (5) and its employees are immune from civil and criminal liability arising from any act or omission that is related to that training.

AB474, s. 5 Section 5. 941.23 of the statutes is renumbered 941.23 (2) (intro.) and amended to read:

AB474,10,24 941.23 (2) (intro.) Any person except a peace officer other than one of the following who goes armed with a concealed and dangerous weapon is guilty of a Class A misdemeanor. Notwithstanding:

AB474,11,3 (a) A peace officer, but notwithstanding s. 939.22 (22), for purposes of this section paragraph, "peace officer" does not include a commission warden who is not a state-certified commission warden.

AB474, s. 6 Section 6. 941.23 (1) of the statutes is created to read:

AB474,11,5 941.23 (1) In this section:

AB474,11,6 (a) "Firearm silencer" has the meaning given in s. 941.298 (1).

AB474,11,7 (c) "Law enforcement agency" has the meaning given in s. 175.48 (1) (b).

AB474,11,8 (e) "Law enforcement officer" has the meaning given in s. 175.48 (1) (c).

AB474,11,10 (f) "Prohibited firearm" means any item under 18 USC 926B (e) or 18 USC 926C (e).

AB474,11,11 (g) "Retired federal officer" has the meaning given in s. 175.48 (1) (d).

AB474,11,14 (h) "Retired nonresident law enforcement officer" means a person who, before retiring, was employed as a law enforcement officer with a law enforcement agency and who does not reside in Wisconsin.

AB474,11,15 (i) "Retired officer" has the meaning given in s. 175.48 (1) (e).

AB474, s. 7 Section 7. 941.23 (2) (b), (c), (d) and (e) of the statutes are created to read:

AB474,11,18 941.23 (2) (b) A law enforcement officer who is carrying a firearm and who is employed by a law enforcement agency if all of the following apply:

AB474,11,20 1. The law enforcement agency that employs him or her has authorized him or her to carry a firearm.

AB474,11,22 2. He or she is carrying the photographic identification issued by the law enforcement agency that employs him or her.

AB474,11,24 3. He or she is not the subject of any disciplinary action by the law enforcement agency that employs him or her.

AB474,12,2 4. He or she meets all standards established by the law enforcement agency to qualify on a regular basis to use a firearm.

AB474,12,3 5. He or she is not prohibited under federal law from possessing a firearm.

AB474,12,4 6. The firearm is not a prohibited firearm.

AB474,12,5 7. He or she is not under the influence of an intoxicant.

AB474,12,6 (c) A retired officer if all of the following apply:

AB474,12,8 1. He or she is carrying a current certification card issued under s. 175.48 (2) (a) or renewed under s. 175.48 (5).

AB474,12,10 2. The weapon is a firearm and is a type that is listed on the current certification card.

AB474,12,11 3. A firearm silencer is not attached to the firearm.

AB474,12,12 4. He or she is not under the influence of an intoxicant.

AB474,12,13 5. He or she is not prohibited under federal law from possessing a firearm.

AB474,12,14 (d) A retired federal officer if all of the following apply:

AB474,12,16 1. He or she is carrying a current certification card issued under s. 175.48 (3) (a) or renewed under s. 175.48 (5).

AB474,12,18 2. The weapon is a firearm and is a type that is listed on the current certification card.

AB474,12,19 3. A firearm silencer is not attached to the firearm.

AB474,12,20 4. He or she is not under the influence of an intoxicant.

AB474,12,21 5. He or she is not prohibited under federal law from possessing a firearm.

AB474,12,22 (e) A retired nonresident law enforcement officer if all of the following apply:

AB474,12,23 1. He or she is carrying one of the following:

AB474,13,4 a. A photographic identification issued by the law enforcement agency from which he or she retired from service as a law enforcement officer that indicates that he or she has, not more than one year before the date he or she is carrying the firearm, been found by the law enforcement agency to meet any standards established by the law enforcement agency for training and qualification for active law enforcement officers to carry a firearm of the same type that he or she is carrying.

AB474,13,11 b. A photographic identification issued by the law enforcement agency from which he or she retired from service as a law enforcement officer and a certification issued by the state in which he or she resides that indicates that he or she has, not more than one year before the date he or she is carrying the firearm, been found by the state to meet the standards established by the state for training and qualification for active law enforcement officers to carry a firearm of the same type that he or she is carrying.

AB474,13,12 2. The weapon is a firearm but is not a prohibited firearm.

AB474,13,13 3. A firearm silencer is not attached to the weapon.

AB474,13,14 4. He or she is not under the influence of an intoxicant.

AB474,13,15 5. He or she is not prohibited under federal law from possessing a firearm.

AB474, s. 8 Section 8. 941.237 (3) (cr), (L), (m) and (n) of the statutes are created to read:

AB474,13,18 941.237 (3) (cr) A law enforcement officer, as defined in s. 175.48 (1) (c), to whom s. 941.23 (2) (b) applies.

AB474,13,21 (L) A retired officer, as defined in s. 175.48 (1) (e), who is carrying a current certification card issued under s. 175.48 (2) (a) or renewed under s. 175.48 (5) and to whom s. 941.23 (2) (c) applies.

AB474,13,24 (m) A retired federal officer, as defined in s. 175.48 (1) (d), who is carrying a current certification card issued under s. 175.48 (3) (a) or renewed under s. 175.48 (5) and to whom s. 941.23 (2) (d) applies.

AB474,14,2 (n) A retired nonresident law enforcement officer, as defined in s. 941.23 (1) (h), to whom s. 941.23 (2) (e) applies.

AB474, s. 9 Section 9. 941.29 (10) (c), (d), (e) and (f) of the statutes are created to read:

AB474,14,5 941.29 (10) (c) The person is a law enforcement officer, as defined in s. 175.48 (1) (c), and s. 941.23 (2) (b) applies to him or her.

AB474,14,8 (d) The person is a retired officer, as defined in s. 175.48 (1) (e), who is carrying a current certification card issued under s. 175.48 (2) (a) or renewed under s. 175.48 (5), and s. 941.23 (2) (c) applies to him or her.

AB474,14,11 (e) The person is a retired federal officer, as defined in s. 175.48 (1) (d), who is carrying a current certification card issued under s. 175.48 (3) (a) or renewed under s. 175.48 (5), and s. 941.23 (2) (d) applies to him or her.

AB474,14,13 (f) The person is a retired nonresident law enforcement officer, as defined in s. 941.23 (1) (h), and s. 941.23 (2) (e) applies to him or her.
