191.30 Authority to adopt. A political subdivision may adopt a farmland
2preservation zoning ordinance.
AB75,1108,4 391.32 Certified ordinance. The following zoning ordinances are certified, for
4the purposes of this chapter and s. 71.613:
AB75,1108,6 5(1) An exclusive agricultural use zoning ordinance that was certified under s.
691.06, 2007 stats., if the certification has not expired or been withdrawn.
AB75,1108,8 7(2) A farmland preservation zoning ordinance that was certified under s. 91.36
8if the certification has not expired or been withdrawn.
AB75,1108,12 991.34 Expiration of zoning certification. (1) The certification of a
10farmland preservation zoning ordinance that was certified under s. 91.06, 2007
11stats., expires on the date provided in the certification or, if the certification does not
12provide an expiration date, on the following date:
AB75,1108,1413 (a) December 31, 2012, for a county with an increase in population per square
14mile of more than 9 percent or a city, village, or town in such a county.
AB75,1108,1715 (b) December 31, 2013, for a county with an increase in population per square
16mile of more than 3.75 percent but not more than 9 percent or a city, village, or town
17in such a county.
AB75,1108,2018 (c) December 31, 2014, for a county with an increase in population per square
19mile of more than 1.75 percent but not more than 3.75 percent or a city, village, or
20town in such a county.
AB75,1108,2321 (d) December 31, 2015, for a county with an increase in population per square
22mile of more than 0.8 percent but not more than 1.75 percent or a city, village, or town
23in such a county.

1(2) The certification of a farmland preservation zoning ordinance that the
2department certifies under s. 91.36 expires on the date specified under s. 91.36 (2).
AB75,1109,6 3(3) For the purposes of sub. (1), a county's increase in population per square
4mile is the percentage by which the county's population per square mile based on the
5department of administration's 2007 population estimate under s. 16.96 exceeds the
6county's population per square mile based on the 2000 federal census.
AB75,1109,10 791.36 Certification of zoning ordinance by the department. (1)
8General. The department may certify a farmland preservation zoning ordinance or
9an amendment to a farmland preservation zoning ordinance as provided in this
10section.
AB75,1109,14 11(2) Certification period. (a) The department may certify a farmland
12preservation zoning ordinance for a period that does not exceed 10 years. The
13department shall specify the expiration date of the certification of the farmland
14preservation zoning ordinance in the certification.
AB75,1109,2115 (b) The certification of an amendment to a certified farmland preservation
16zoning ordinance expires on the date that the certification of the farmland
17preservation zoning ordinance expires, except that the department may treat a
18comprehensive revision of a certified farmland preservation zoning ordinance as a
19new farmland preservation zoning ordinance and specify an expiration date for the
20certification of the revised farmland preservation zoning ordinance as provided in
21par. (a).
AB75,1109,25 22(3) Scope of department review. (a) The department may certify a farmland
23preservation zoning ordinance or amendment to a farmland preservation zoning
24ordinance based on statements submitted under s. 91.40 (3) and (4), without
25conducting any additional review or audit.

1(b) The department may do any of the following before it certifies a farmland
2preservation zoning ordinance or amendment:
AB75,1110,43 1. Review the farmland preservation zoning ordinance or amendment for
4compliance with the requirements under s. 91.38.
AB75,1110,65 2. Review and independently verify the application for certification, including
6the statements under s. 91.40 (3) and (4).
AB75,1110,9 7(4) Denial of certification. The department shall deny an application for
8certification of a farmland preservation zoning ordinance or amendment if the
9department finds any of the following:
AB75,1110,1110 (a) That the farmland preservation zoning ordinance or amendment does not
11comply with the requirements in s. 91.38.
AB75,1110,1212 (b) That the application for certification does not comply with s. 91.40.
AB75,1110,17 13(5) Written decision; deadline. The department shall grant or deny an
14application for certification under this section no more than 90 days after the day on
15which the political subdivision submits a complete application, unless the political
16subdivision agrees to an extension. The department shall issue its decision in the
17form required by s. 227.47 (1).
AB75,1110,22 18(6) Conditional certification. The department may grant an application for
19certification under this section subject to conditions specified by the department in
20its decision under sub. (5). The department may certify a farmland preservation
21zoning ordinance or amendment contingent upon the political subdivision adopting
22the farmland preservation zoning ordinance or amendment as certified.
AB75,1111,2 23(7) Effective date of certification. A certification under this section takes
24effect on the day on which the department issues the certification, except that if the
25department specifies conditions under sub. (6), the certification takes effect on the

1day on which the department determines that the political subdivision has met the
2conditions.
AB75,1111,6 3(8) Amendments to ordinances; certification. (a) Except as provided in par.
4(b), an amendment to a certified farmland preservation zoning ordinance is
5automatically considered to be certified as part of the certified farmland preservation
6zoning ordinance.
AB75,1111,97 (b) An amendment to a certified farmland preservation zoning ordinance that
8is one of the following and that is adopted after the effective date of this paragraph
9.... [LRB inserts date], is not automatically considered to be certified:
AB75,1111,1110 1. An amendment that is a comprehensive revision of a certified farmland
11preservation zoning ordinance.
AB75,1111,1312 2. An amendment that extends coverage of a certified farmland preservation
13zoning ordinance to a town that was not previously covered.
AB75,1111,1614 3. An amendment of a type specified by the department by rule that may
15materially affect compliance of the certified farmland preservation zoning ordinance
16with the requirements under s. 91.38.
AB75,1111,2217 (c) The department may withdraw certification of a farmland preservation
18zoning ordinance if, as a result of an amendment adopted after the effective date of
19this paragraph .... [LRB inserts date], the amended farmland preservation zoning
20ordinance fails to comply with the requirements under s. 91.38. This paragraph
21applies regardless of whether the farmland preservation zoning ordinance was
22originally certified under s. 91.06, 2007 stats., or under this section.
AB75,1112,223 (d) A political subdivision shall notify the department in writing whenever the
24political subdivision adopts an amendment that is described in par. (b) 1. to 3. to a
25certified farmland preservation zoning ordinance. The political subdivision shall

1include a copy of the amendment in the notice. This paragraph does not apply to an
2amendment that rezones land out of a farmland preservation zoning district.
AB75,1112,5 391.38 Requirements for certification of ordinance. (1) A farmland
4preservation zoning ordinance does not qualify for certification under s. 91.36 unless
5all of the following apply:
AB75,1112,86 (a) The farmland preservation zoning ordinance includes jurisdictional,
7organizational, and enforcement provisions that are necessary for proper
8administration.
AB75,1112,119 (c) The farmland preservation zoning ordinance clearly designates farmland
10preservation zoning districts in which land uses are limited in compliance with s.
1191.42.
AB75,1112,1612 (d) The farmland preservation zoning ordinance includes maps that clearly
13delineate each farmland preservation zoning district, so that a reader can easily
14determine whether a parcel is within a farmland preservation zoning district; that
15are correlated to the text under par. (e); and that comply with technical specifications
16that the department establishes by rule.
AB75,1112,1817 (e) The text of the farmland preservation zoning ordinance clearly describes the
18types of land uses authorized in each farmland preservation zoning district.
AB75,1112,2019 (f) The farmland preservation zoning ordinance is substantially consistent
20with a certified farmland preservation plan.
AB75,1112,2321 (g) Except as provided by the department by rule, land is not included in a
22farmland preservation zoning district unless the land is included in a farmland
23preservation area identified in the county certified farmland preservation plan.
AB75,1112,2524 (h) If an overlay district, such as an environmental corridor, is superimposed
25on a farmland preservation zoning district, all of the following apply:

11. The farmland preservation zoning ordinance clearly identifies the overlay
2district as such.
AB75,1113,53 2. The overlay district is shown on the maps under par. (d) in a way that allows
4a reader to easily identify the underlying farmland preservation zoning district and
5its boundaries.
AB75,1113,76 3. The overlay district does not remove land use restrictions from the
7underlying farmland preservation zoning district.
AB75,1113,98 (i) The farmland preservation zoning ordinance complies with any other
9requirements that the department specifies by rule.
AB75,1113,13 10(2) An amendment to a farmland preservation zoning ordinance qualifies for
11certification under s. 91.36 if it complies with all of the requirements in sub. (1) that
12are relevant to the amendment and it does not cause the farmland preservation
13zoning ordinance to violate any of the requirements in sub. (1).
AB75,1113,18 1491.40 Applying for certification of ordinance. A political subdivision
15seeking certification of a farmland preservation zoning ordinance or amendment to
16a farmland preservation zoning ordinance shall submit all of the following to the
17department in writing, along with any other relevant information that the political
18subdivision chooses to provide:
AB75,1113,20 19(1) The complete farmland preservation zoning ordinance or amendment
20proposed for certification.
AB75,1113,21 21(2) All of the following background information:
AB75,1113,2422 (a) A concise summary of the farmland preservation zoning ordinance or
23amendment, including key changes from any previously certified farmland
24preservation zoning ordinance.

1(b) A concise summary of the process by which the farmland preservation
2zoning ordinance or amendment was developed, including public hearings, notice to
3and involvement of other governmental units, approval by the political subdivision,
4and identification of any key unresolved issues with other governmental units
5related to the farmland preservation zoning ordinance or amendment.
AB75,1114,96 (c) A description of the relationship of the farmland preservation zoning
7ordinance or amendment to the county certified farmland preservation plan,
8including any material inconsistencies between the farmland preservation zoning
9ordinance or amendment and the county certified farmland preservation plan.
AB75,1114,12 10(3) A statement, signed by the county planning director or the chief elected
11official, certifying that the farmland preservation zoning ordinance or amendment
12complies with s. 91.38 (1) (g) and (h).
AB75,1114,15 13(4) A statement, signed by the applicant's attorney or chief elected official,
14certifying that the farmland preservation zoning ordinance or amendment complies
15with all applicable requirements in s. 91.38.
AB75,1114,16 16(5) Other relevant information that the department requires by rule.
AB75,1114,20 1791.42 Land use in farmland preservation zoning districts; general. A
18farmland preservation zoning ordinance does not qualify for certification under s.
1991.36, if the farmland preservation zoning ordinance allows a land use in a farmland
20preservation zoning district other than the following land uses:
AB75,1114,21 21(1) Uses identified as permitted uses in s. 91.44.
AB75,1114,22 22(2) Uses identified as conditional uses in s. 91.46.
AB75,1114,23 23(3) Prior nonconforming uses, subject to the following:

1(a) A prior nonconforming use that is a residence may be expanded or
2remodeled, as long as there is no increase in the number of dwelling units in the
3residence.
AB75,1115,54 (b) A prior nonconforming use that is not a residence may continue without
5further approval unless it is materially altered.
AB75,1115,76 (c) The proposed farmland preservation zoning districts under the farmland
7preservation zoning ordinance contain only isolated prior nonconforming uses.
AB75,1115,8 8(4) Other uses allowed by the department by rule.
AB75,1115,12 991.44 Permitted uses. (1) A farmland preservation zoning ordinance does
10not comply with s. 91.42 if the farmland preservation zoning ordinance allows as a
11permitted use in a farmland preservation zoning district a land use other than the
12following land uses:
AB75,1115,1313 (a) Agricultural uses.
AB75,1115,1414 (b) Accessory uses.
AB75,1115,1515 (c) Agriculture-related uses.
AB75,1115,1716 (d) Nonfarm residences constructed in a rural residential cluster in accordance
17with an approval of the cluster as a conditional use under s. 91.46 (1) (e).
AB75,1115,1818 (e) Undeveloped natural resource and open space areas.
AB75,1115,2219 (f) A transportation, utility, communication, or other use that is required under
20state or federal law to be located in a specific place or that is authorized to be located
21in a specific place under a state or federal law that preempts the requirement of a
22conditional use permit for that use.
AB75,1115,2323 (g) Other uses identified by the department by rule.

1(2) The department may promulgate rules imposing additional limits on the
2permitted uses that may be allowed in a farmland preservation zoning district in
3order for a farmland preservation zoning ordinance to comply with s. 91.42.
AB75,1116,7 491.46 Conditional uses. (1) General. A farmland preservation zoning
5ordinance does not comply with s. 91.42 if the farmland preservation zoning
6ordinance allows as a conditional use in a farmland preservation zoning district a
7land use other than the following land uses:
AB75,1116,88 (a) Agricultural uses.
AB75,1116,99 (b) Accessory uses.
AB75,1116,1010 (c) Agriculture-related uses.
AB75,1116,1211 (d) Nonfarm residences that qualify under sub. (2) or that meet more restrictive
12standards in the farmland preservation zoning ordinance.
AB75,1116,1413 (e) Nonfarm residential clusters that qualify under sub. (3) or that meet more
14restrictive standards in the farmland preservation zoning ordinance.
AB75,1116,1615 (f) Transportation, communications, pipeline, electric transmission, utility, or
16drainage uses that qualify under sub. (4).
AB75,1116,1817 (g) Governmental, institutional, religious, or nonprofit community uses, other
18than uses covered by par. (f), that qualify under sub. (5).
AB75,1116,1919 (h) Nonmetallic mineral extraction that qualifies under sub. (6).
AB75,1116,2120 (i) Oil and gas exploration or production that is licensed by the department of
21natural resources under subch. II of ch. 295.
AB75,1116,2222 (j) Other uses allowed by the department by rule.
AB75,1117,2 23(1m) Additional limitations. The department may promulgate rules imposing
24additional limits on the conditional uses that may be allowed in a farmland

1preservation zoning district in order for a farmland preservation zoning ordinance
2to comply with s. 91.42.
AB75,1117,4 3(2) Nonfarm residences. A nonfarm residence qualifies for the purposes of sub.
4(1) (d) if the political subdivision determines that all of the following apply:
AB75,1117,75 (a) The ratio of nonfarm residential acreage to farm acreage on the base farm
6tract on which the nonfarm residence will be located will not be greater than 1 to 20
7after the nonfarm residence is constructed.
