ASSEMBLY AMENDMENT 7, TO 2011 ASSEMBLY BILL 94

AB94-AA7,1,1 At the locations indicated, amend the bill as follows:

AB94-AA7,1,2 1. Page 1, line 3: after "Program" insert "and making an appropriation".

AB94-AA7,1,3 2. Page 2, line 1: after that line insert:

AB94-AA7,1,4 " Section 1g. 20.255 (2) (fu) of the statutes is amended to read:

AB94-AA7,1,6 20.255 (2) (fu) Milwaukee parental choice program. A sum sufficient to make the payments to private schools under s. 119.23 (4) and , (4m), and (10) (e).".

AB94-AA7,1,7 3. Page 2, line 1: substitute "Section 1r" for "Section 1".

AB94-AA7,1,9 4. Page 5, line 19: delete "The" and substitute "The Except as provided in par. (e), the".

AB94-AA7,1,10 5. Page 5, line 21: after that line insert:

AB94-AA7,1,11 " Section 7m. 119.23 (10) (e) of the statutes is created to read:

AB94-AA7,2,6 119.23 (10) (e) 1. Notwithstanding subs. (4) and (4m), and except as provided in subd. 2., if the state superintendent issues an order under par. (a), (am), or (b) barring the private school from participating in the program under this section in the school year in which the order is issued, the department shall pay to the private school in that school year, from the appropriation under s. 20.255 (2) (fu), an amount determined as follows:

AB94-AA7,2,9 a. Divide the number of instructional hours provided to pupils in that school year before the order was issued under par. (a), (am), or (b) by the number of instructional hours scheduled in that school year.

AB94-AA7,2,11 b. Multiply the quotient under subd. 1. a. by the amount under sub. (4) (b) or (bg).

AB94-AA7,2,13 c. Subtract from the product under subd. 1. b. any amount already paid to the private school in that school year.

AB94-AA7,2,16 2. This paragraph does not apply to a private school barred from participating in the program under this section under par. (a), (am), or (b) as a result of committing an act of fraud.

AB94-AA7,2,18 3. A private school who receives a payment under this paragraph shall use the payment received in the following order:

AB94-AA7,2,20 a. If the private school owes money to the state, the private school shall reimburse the state.

AB94-AA7,2,23 b. The private school shall use any portion of the payment remaining after satisfying the requirement under subd. 3. a. to pay the salaries of teachers employed by the school.".

AB94-AA7,2,24 6. Page 6, line 5: after that line insert:

AB94-AA7,3,2 " Section 10. Effective dates. This act takes effect on the day after publication, except as follows:

AB94-AA7,3,4 (1) The treatment of section 119.23 (10) (e) of the statutes takes effect retroactively to July 1, 2006.".
