SENATE AMENDMENT 9, TO SENATE BILL 1

January 18, 2011 - Offered by Senator Kedzie.

SB1-SA9,1,1 At the locations indicated, amend the bill as follows:

SB1-SA9,1,3 1. Page 22, line 2: after "product" insert ", or a person on whose behalf a claim for such damages or other relief is asserted".

SB1-SA9,1,4 2. Page 22, line 6: after "all actions" insert "in law or equity".

SB1-SA9,1,5 3. Page 22, line 24: after "seek" insert "any".

SB1-SA9,1,6 4. Page 22, line 25: delete "another" and substitute "any other".

SB1-SA9,1,8 5. Page 23, line 2: delete "product chemically" and substitute "manufactured product chemically and physically".

SB1-SA9,1,10 6. Page 23, line 5: delete "product" and substitute "complete integrated product, in the form used by the claimant or to which the claimant was exposed, and".

SB1-SA9,1,11 7. Page 23, line 7: after "chemically" insert "and physically".

SB1-SA9,2,2 8. Page 23, line 9: delete "this state" and substitute "the geographic market where the injury or harm is alleged to have occurred".

SB1-SA9,2,3 9. Page 23, line 11: after that line insert:

SB1-SA9,2,5 "c. Was distributed or sold without labeling or any distinctive characteristic that identified the manufacturer, distributor, seller, or promoter.".

SB1-SA9,2,6 10. Page 23, line 13: delete ", during the relevant production period,".

SB1-SA9,2,9 11. Page 23, line 14: after "this state" insert "during the relevant production period by all manufacturers of the product in existence during the relevant production period".

SB1-SA9,2,10 12. Page 23, line 19: delete "a product" and substitute "the specific product".

SB1-SA9,2,11 13. Page 31, line 3: delete lines 3 to 5.
