SENATE AMENDMENT 2, TO SENATE BILL 12

October 25, 2011 - Offered by Senator Zipperer.

SB12-SA2,1,1 At the locations indicated, amend the bill as follows:

SB12-SA2,1,2 1. Page 3, line 8: delete "Except as provided in par. (c), in" and substitute "In".

SB12-SA2,1,7 2. Page 3, line 9: delete the material beginning with "reasonable" and ending with "awarded." on line 10 and substitute "the court shall presume that reasonable attorney fees do not exceed 3 times the amount of the compensatory damages awarded but this presumption may be overcome if the court determines, after considering the factors set forth in sub. (1), that a greater amount is reasonable.".

SB12-SA2,1,8 3. Page 3, line 15: delete lines 15 to 20 and substitute:

SB12-SA2,1,11 "(3) This section does not abrogate the rights of persons to enter into an agreement for attorney fees, and the court shall presume that such an agreement is reasonable.".
